The Giudices Should Work Out a Plea Deal Because the Evidence Points to Their Guilt (Updated 3/12/2014)

UPDATE MARCH 12, 2014: According to the March 17, 2014 print issue of US Weekly, Joe and Teresa Giudice “decided that accepting a plea deal was in the best interest of the entire family.” The following is a report on the story from Celebrity Dirty Laundry:

Supposedly they didn’t want their four daughters to be hurt by the damage and crazy press coverage that a trial would have brought. HA!

This might be the first time in years that Teresa wanted her kids to avoid media coverage. Usually she seems to be shoving them in front of the cameras; and I’m not buying that they suddenly want to protect the kids for one minute. If that was truly the case then they wouldn’t have decided to tell them that they both could be going to jail while Bravo’s camera’s rolled!

“I want to make sure everybody knows that there were NO cameras rolling yesterday on private matters with my daughters.” – Teresa Giudice, March 5, 2014, Twitter

I think Teresa just is hoping that she can use her kids to kind of lessen the hostility that people may feel for her in general.

If you watch The Real Housewives of New Jersey then you have seen Teresa repeatedly turn herself into a victim. It’ll be hard for her to do that in this situation unless she decides to completely roll on her husband.

The Giudices should have seriously considered a plea deal, especially when taking into account the last time Joe testified in his own defense. In an opinion letter about Juicy’s testimony in December 2010 during a civil case filed against him by his former business partner, Joe Mastropole, U.S. bankruptcy judge Morris Stern wrote:

 J. Giudice was not being truthful when he averred that Mastropole had authorized the signing of his name on Exhibit P-6.29. The signing of Mastropole’s name was a forgery, made with business motives (i.e., to garner funds through refinancing transactions), exhibiting willfulness and malice toward a former friend and current adversary. The extraordinary web of lies and misrepresentations woven by Giudice to implement and cover his misconduct reflects on his approach to business matters, and suggests his disregard for legal restraints which would bind others… Even if these arguments were to have some merit if a truth-telling, law-respecting party were defending, that is not the present case. Giudice is that party defendant who brazenly “notarized” (by forgery) his own forgery of his business associate’s signature, and otherwise fabricated stories (e.g., the Testa “witnessing” that was not), all with reckless abandon. It is not difficult to see Giudice rationalizing that payment of $300,000 was “enough” for Mastropole, and if Mastropole were eventually to discover the forgery, Giudice would come up with something (such as the oral authorization ploy) when pressed. The worst fate that would befall him would be that he be made to pay what he owed through the settlement agreement.

In season 4 episode 14, Teresa and Joe taped a scene with their bankruptcy attorney, James Kridel, regarding the fraud case filed against them by Joe’s former business partner, Joe Mastropole. During an interview segment (TH), Teresa addressed the fact that Joe had forged his former business partner’s name on mortgage documents. Believing Joe’s admission to forgery was the reason for the judgment in favor of Mastropole (Joe Giudice was ordered to pay $260,000 still owed as part of their business divorce agreement), Teresa said: “See! You gotta lie!” (click here for the clip). Apparently, Teresa lied when she testified in the case, which cleared her of any responsibility for paying off Mastropole even though she also signed the business divorce agreement.

The following is a synopsis of Mastropole v. Giudice (bankruptcy judge, Judge Morris Stern, concluded that the money owed to Mastropole should be excepted from the Guidice’s bankruptcy discharge).

Teresa also was named in the fraud case filed by Joe Mastropole and was called to testify because she had signed the business divorce agreement which obligated the Giudices to pay Mastropole a total of $586,000 — $300,000 immediately with an ultimate payoff by December 1, 2007. The Giudices breached the agreement by failing to pay off the balance owed of $286,000; instead, they included it in their bankruptcy petition filed on October 29, 2009 as debt to be discharged. Mastropole filed a lawsuit to prevent the debt from being discharged.

During testimony at the proceeding in Mastropole v. Giudice on November 19, December 14 and December 15, 2010, Teresa was not implicated in any of the actual business affairs between Mastropole and J. Giudice, other than she had been a titleholder to certain property and had signed the business divorce agreement.

Attorney John Testa took the witness stand and said he represented the Giudices in the business divorce litigation with Mastropole, which was to have culminated with the June 13, 2007 settlement agreement. Testa identified the personal guarantee in the settlement agreement appeared to have been signed by Teresa and Joe Giudice and witnessed by himself. As to his witnessing the Giudices’ signatures, Testa said that J. Giudice signed in his presence, but Teresa’s signature was already on the guarantee when her husband brought it to him. Testa said he “would not accept that that way,” and said he telephoned Teresa to question her about the document. Testa said he went through it with her “and made sure that was, in fact, her signature.”

Teresa confirmed that she did not work in her husband’s real estate business or with Mastropole-J. Giudice business ventures. “I was not involved in their business,” as she put it. She said she recently she became aware that her name was “on” certain real estate. She testified that she never met Testa and that she did not recall the guarantee nor any telephone conversation with Testa about the guarantee. Wrote Judge Morris Stern: “Teresa was vague throughout most of her testimony, and particularly so in this regard. The singular area of Teresa’s testimony which was firm and emphatic was as to her purported signature on the personal guarantee. She said she did not sign the document.”

On cross-examination regarding Teresa’s signature on the guarantee, J. Giudice said: “I might have signed that . . . I don’t know.” He also said he did not know if Testa had called Teresa about the guarantee. J. Giudice also confirmed that he didn’t tell Testa about the Mastropole discharge of mortgage.

When the plaintiff’s case ended and the defense moved for dismissal, the court denied the motion as to J. Giudice; however, the court dismissed the case against Teresa in its entirely based upon the total absence of evidence connecting her (other than as a spouse) to her husband’s real estate business affairs, not because they believed her testimony.

Teresa pool

A source told FW in the Fall of 2013 that the feds have recordings of Teresa with mortgage bankers that back up the charges and that the Giudices have tried twice to work out a deal where Teresa won’t get prison time, but the U.S. attorneys said no, especially since they are annoyed that she is claiming to be both innocent of, and ignorant about, the charges and keeps saying she doesn’t know why this is happening to them. The source also said that Teresa believes if her case goes to trial a jury won’t convict her.

During the reunion special for season 5, Teresa said she reached out to Caroline Manzo when she and Juicy were indicted on money fraud because she knew the Manzo’s good friend, Bernie Kerik, had recently served time in federal prison after pleading guilty of some similar charges. Teresa said: “I always liked Bernie.”

Kerik is Al’s best friend according to Caroline (in the final episode of season 1). Kerik, a former New York police commissioner, was released from federal prison in May 2013 after serving three and a half years of a four year-sentence.

Kerik initially planned to fight the charges in October 2009, but eventually pleaded guilty in November 2009 to eight felony charges, including tax fraud, accepting kickbacks, lying to the White House on documents vetting his fitness to serve in the Cabinet, and lying on loan applications.

Kerik was a close ally of former NYC Mayor Rudy Giuliani, whom he served as a bodyguard and driver. Giuliani then tapped him for a senior position in the Correction Department, and he went on to become the agency’s commissioner.

Kerik’s performance after the 9/11 attacks turned him into a national figure, and President George W. Bush nominated him to lead the newly-created Department of Homeland Security. That bid quickly collapsed in scandal, marking the beginning of the end of Kerik’s career.

Kerik was sentenced to four years in prison in February 2010 after a federal judge blasted him for using his high-profile part in the city’s 9/11 response to make money.

In a November 2009 deal he made with federal prosecutors, Kerik’s pleaded guilty to lying to the White House, filing false tax returns, and lying about $255,000 in work done by a mob-linked contractor. A humiliated Kerik wept on the witness stand while testifying against the two brothers accused of covering up the free remodeling of the ex-commissioner’s Riverdale apartment – Kerik sought to help a city contractor in exchange for extensive renovations to his apartment.

Al Manzo, a Kerik pal and owner of The Brownstone restaurant in Paterson, said the former cop’s wife, other family members and close friends were gathering for a robust “Welcome Home” meal.

“Bernie’s looking for some of the good food he hasn’t been able to get for the last three years,” Manzo told the Daily News. “I’m his friend — I’m there for him.

“He loves fresh mozzarella, shrimp scampi, beef short ribs.”

“He did his time like a man,” said Manzo, adding that the once-beefy Kerik’s weight was down to 175 pounds. “I think he deserves a chance to get his life back on track.”

The ex-top cop surrendered on May 17, 2010, but earned time off for good behavior that cleared him to leave the Cumberland, Maryland, facility and actually begin home confinement on May 23, prison officials said.

http://www.nydailynews.com/new-york/nypd-boss-bernard-kerik-prison-article-1.1356234

Prior to his incarceration, Kerik ran a private security consulting business and trained security dogs.

Based on the photo of his home below (more photos here), it looks like Kerik’s family was able to maintain their lifestyle despite his imprisonment (prior to his arrest, Kerik also was able to afford a separate apartment in New York).

Kerik's house

In December 2008, Al Manzo hosted a fund-raiser at The Brownstone to raise money for Kerik’s legal defense – he was scheduled to face trial in October 2009 but instead pleaded guilty in November 2009. Looks like Kerik has done pretty well for himself. Perhaps he should have downsized before asking others for money to help him fight charges of bank fraud, accepting kickbacks, tax evasion and perjury.

In August 2013, a month after she and Joe were indicted for money fraud, Teresa considered taking the same route as Bernie Kerik by scheduling a fundraiser at the Maliblue Oyster Bar to “collect donations to support her legal defense,” but when she was called out on it by bloggers, she claimed the press release was a PR stunt to drum up business for the restaurant.

FW reader gessiewtf posted a comment for Joe Giudice, imploring him to work out a plea deal and spare himself and his family a long, drawn-out legal process. The following is her post.

I think that this is what should happen. Joe’s lawyers should have the charges, which are deliberate overkill to let them know that they have no compunction about putting Teresa in jail, dropped against his wife in exchange for pleading guilty to the things that he is guilty of – failing to file tax returns and most certainly a few of the other counts.

The government will fight back, but I don’t think they have a perfect case. They want him to go down for some of the stuff. He should do whatever it takes to keep his wife out of jail.

Her own attorney should be advising her about her own life and how to keep it with her kids. Time to think about yourself, Teresa, and how to stay out of jail for those girls.

Juicy should plead it down to five years with all charges against his wife dropped. Enough with the tough guy attitude. I know he thinks he is innocent, but he has committed some crimes which are obvious.

Hell, my father was charged with arson (he burnt down a house he couldn’t sell). He had his vintage Bentley stolen from his club and burnt down for the insurance money. That was how he came to the attention of the feds [the Giudices filing bankruptcy brought them to the attention of the feds]. Who would steal a classic car and just burn it? it didn’t make sense. He didn’t file taxes for six years. He was accused of buying and selling stolen property. Bank fraud, loan fraud, mail and wire fraud.

In the end, after blowing every dime he had and proclaiming his innocence, and after a five-year trial, he did six months in a federal prison. Our family was destroyed, everything we owned was seized, he could never get a job or have a credit card for the rest of his life, and all of his kids were fucked up in one way or another. Self-esteem of children shot to hell. Mother dies young of stress.

Just plead guilty after the lawyers have fought back and forth for your lightest sentence and leave your wife out of it. If my father had involved my mother, I would have shot him myself. Throw yourself on your sword, Juicy. I love you to death, but you are guilty of not filing tax returns and some other shit.

Do the right thing and stop sitting there holding your wife’s hand and get her ass out of trouble. By not having a five-year trial, you can leave the wife and the kids a little cash so that they are not destitute. Don’t put her through a trial at all!

Do the right thing. I know it’s not fair. You are not guilty of all 39 counts, maybe five or six will do. But do not make your wife go through a criminal trial. You take the fall. Most of the charges are bullshit, but some are not. And for the love of Gd, I hope Teresa’s attorney is advising her as to what is best for her, even if it is to flip on him. I don’t care.

It doesnt seem to me like Joe is willing to take the fall alone.

“… and lying on loan applications”, this entire case (Teresa and Joe) should be interesting.

I see where the commenter is coming from, but every count has teeth to it. None of it was made up, they can back it up. For them to give Joe 3 to 5 years for 39 counts and have Teresa serve no time won’t happen. Teresa was in on it as much and as deep as Joe, she loves to play dumb but she isn’t. I love Teresa but what I think happened is as one story that was on here saying that Teresa loved to shop and wanted everything and Joe did what he could to give her that. And so I bet Joe told her everybody does it and with the money coming in from the fraud she thought it was okay. Teresa is going to get some time, pure and simple. Joe is going away for at least 10 years if not more and may get deported right after.

But what I think the Feds want is him to squeal/snitch on people. The Feds aren’t dumb, they know that NJ is a hotbead of corruption and shady dealings and Joe knows stuff. And believe me Joe is acting tough, but when it starts to come down that he is looking at 20 years or 30 and his wife is looking at 5 to 10 years, he will squawk believe me.

Is this your opinion Buck or do have experience in this arena, eg., are you a Lawyer?

I can only comment on the sentences handed down in our area for crimes far more serious than the ones Joe and Teresa are accused of.

“On November 13, 2009, Jefferson was sentenced to thirteen years in federal prison for bribery after a corruption investigation, the longest sentence ever handed down to a congressman for bribery or any other crime.”

“Edwards was found guilty on seventeen of twenty-six counts, including racketeering, extortion, money laundering, mail fraud and wire fraud; his son Stephen was convicted on 18 counts. “I did not do anything wrong as a governor, even if you accept the verdict as it is, it doesn’t indicate that,” Edwards told the press after his conviction. On his way to prison he said, “I will be a model prisoner, as I have been a model citizen”. From 2002 to 2004 Edwin Edwards was incarcerated at the Federal Medical Center in Fort Worth, Texas.” He was released from prison in January of 2011 and now stars in the reality show, The Governor’s Wife, which premieres October 27.

There are so many players in Mayor Nagin’s case, I will post the link. None of the sentences handed down so far came close to 20 or 30 years and trials are still pending. This all started in 2005.

        http://www.wwltv.com/news/local/Nagin-Key-Players-181197501.html

As EARetired has stated and I believe, most of these “charges” will evaporate before trial .

Buck, I must ask, why do you think Joe would get 20 to 30 years?

You write with such confidence Buck. Are you an attorney? Btw, Teresa will never go to prison. Very difficult to take both parents away from children. If convicted, she will likely have heavy fines and community service for a very very long time.

My BIL is a fraud attny in NJ and he has read the entire indictment. If both T and Joe are convicted and required to serve time, the court systems can make arrangements so that they do not serve their sentence at the same time. For example, T goes for 12 months and when she is released then Juicy would go for his term of say 36 months……the children will have one parent with them at all times…..Yes, those children having parental supervision is the most important thing at this point…..

          • October 23, 2013 at 9:29 PM

If T does time I sure hope what your BIL said applies for them.

Me too Gloria – he is actually REALLY good at his job my BIL (he did money laundering cases for years), so I hope for the sake of T and J he is correct and they can negotiate this….

I never said that the counts were not valid, but many of them are petty and if you don’t think that this whole thing should and could be plea bargained to a logical conclusion you are will just have to agree to disagree. Teresa does not have to go to jail at all. All he has to do is make a deal with the feds to have her name dropped from the indictment. And do the time himself and protect his family. She just signed whatever he told her to sign. In most cases, including my father they are always willing to give a lesser sentence if you flip on a bigger fish. The show was not real, no part of it was real, the producers told them to act like they were spending cash like mad. That can be proven. It was their storyline. They are pissed about the insult to the bancruptcy court, and his continued willful disregard for the law. He has an excellent legal team. If he wanted to, he could take a plea for prison time in exchange for copping to some of his charges and dropping the case against his wife. Happens all the time. We aren’t talking about Bernie Madoff here. We are talking about a man who thinks he has eggs for human reproduction. He should do the time. This is not the crime of the century. But he should do the right thing and save his wife and four daughters from utter ruin. Let’s ask a lawyer how many cases get pled and how many go to trial. I would guess it is 50-50. His lawyers could be encouraging him to go to trial so that they make a lot of money. Let’s hope that is not the case. Her lawyer should be looking out for her. She has to put her love for Joe aside and worry about four little girls that will not thrive without their mother. I don’t care who they stay with. It is all do-able. What is so bad about being deported to Italy? I wish someone would deport me to Italy. He has a difficult choice. Continue with this bullshit, or use the excellent skills and respect that his lawyers have to negotiate a plea bargain. If he goes to trial or plea bargains he is still going to do the same time no matter what. At least this way maybe his family can afford a three bedroom one bath house.

Hi Gessie, I understand what u are saying, BUT……..I think they are probably waiting for the results of the DUI court stuff next week before they actively prepare plea deals…just my opinion, but I don;t think we will see anything until that is decided…

        October 22, 2013 at 1:10 PM

I disagree with much of what Buck says but I think s/he has hit on an important issue:

The question isn’t whether Joe Giudice should work out a plea deal; it’s whether Teresa Giudice should.

Although the media and some posters love to repeat it, thanks to Fame’s comprehensive reporting we know that the truth is Teresa isn’t facing 39 counts; Joe is. (This is because Teresa isn’t included in the tax counts.) The counts that Teresa is facing are related to the bank loans and to her bankruptcy court petition and testimony with respect to TG Fabulicious and her book deal.

I do not think Teresa will ever be convicted in connection with the bank loans. Ever. In light of the facts that we know, that’s just not going to happen.

What we don’t know is how much exposure she has with respect to TG Fabulicious (which, as I understand it, was essentially a website operation similar to Caroline’s 4MyMom or whatever it was called) and the book deal.

WHAT I THINK HAPPENED: Joe’s financial dealings appear to me to be fairly complex. It is my supposition that he would have had to have had bookkeepers or accountants of some type and he said as much on WWHL. In my mind’s eye, I picture him in his initial trip to the bankruptcy attorney — who I do not think had much if any contact with Teresa — just telling him to call his accountant(s) and they would tell him anything he wanted to know.

Joe’s accountants, however, were probably not involved in something that was new for the family, i.e., Teresa’s separate financial activities. According to Whosis, the tgfabulicious domain name was purchased in May of 2009, just five months before the bankruptcy was filed. And I suspect Teresa wasn’t doing that on her own; almost certainly there was a “team” of some sort handling that. And others would have certainly been involved with the book deal as well.

I think it’s really important to think about the dynamic of this couple, i.e., Joe Giudice did not involve his wife in his business deals, period. This is evidenced by, among other things, the fact that he went so far as to forge her name on a power of attorney to ensure that very thing! And it was Joe’s business dealings that led him to decide to file for bankruptcy. (However scripted, I suspect there was some truth in Teresa saying on the RHONJ that she didn’t even know they were going to file for bankruptcy; it’s so incredible, it’s difficult for me to imagine Bravo/Sirens would even think to make that up.) Joe probably would have filed for bankruptcy on his own if he could have but, in this case, he couldn’t for the simple reason that he’d put Teresa’s name on all the real estate.

My guess is that that is why the bankruptcy attorney — who almost certainly did not talk directly to Teresa as much as he should have but relied instead mostly if not entirely on Joe — took the information he put on the bankruptcy petition from Joe’s accountants, who knew nothing about Teresa’s business and which, again, was very new. Because she was on TV the attorney would have known to ask about her Bravo salary and that’s why it is on the petition.

In addition, I doubt that Teresa had an opportunity to review the bankruptcy petition before signing the first couple of pages and, even if she had, she would have never known to look for either TG Fabulicious or the book deal in that mess of numbers, even if it occurred to her to think they should be on there.

So again, I don’t see a conviction for Teresa with respect to the omissions from the bankruptcy petition.

That leaves the matter of Teresa’s testimony before the bankruptcy court. If I understand it correctly, Teresa testified that it was her understanding that TG Fabulicious and the book deal didn’t have to be reported on the bankruptcy petition because they were not in existence at the time the petition was filed. The bankruptcy trustee took umbrage with that since a separate bank account for TG Fabulicious had been opened in Teresa’s name alone — PRESUMING NO ONE FORGED HER SIGNATURE — and slightly over $106,000 had been deposited in the account — PRESUMABLY FROM THE SALE OF GOODS BUT WHO KNOWS — and with slightly more than $105,000 coming out of it — PRESUMABLY SPENT BY TERESA BUT, AGAIN, WHO CAN KNOW FOR SURE?

I have no idea why that was her testimony, where she got that impression, what the relevant dates were or how much she knew about them. It’s possible she was told that by Joe, the bankruptcy attorney, and/or the people operating TG Fabulicious. Interestingly, the bankruptcy petition was amended to include the things Joe had omitted but it was never amended to include TG Fabulicious or the book deal, which suggests the possibility that the bankruptcy attorney may have thought, rightly or wrongly, that there was a legitimate reason for excluding them.

In order to convict someone of a crime one has to prove they had criminal intent; if Teresa can provide a truthful, believable and — best case scenario — provable explanation for that testimony, she could potentially be cleared of those charges as well. But that is where I see that she has exposure and what I would guess is the sticking point in plea negotiations, i.e., the DOJ believes she did have criminal intent and, given her high profile (and supported by the outpouring of vitriol against her in some blog posts) they are reluctant to give her a deal that doesn’t involve jail time.

Teresa and Joe, on the other hand, may know that Teresa was repeatedly mislead, lied to and deliberately kept in the dark and that, as a result, strongly hold the position that imprisoning her for any period of time would be a gross injustice to her and a terrible blow to their children.

If Joe’s not taking a plea, it’s likely it’s because the deal that’s been offered is a package that includes punishment for Teresa that goes beyond what they think she will likely get at trial.

There is great concern among the legal community, judges and lawyers alike, about the imbalance in the system resulting in innocent people being pressured into taking plea bargains. It is clearly in Joe’s best interest for him to take a plea; he almost certainly will be convicted of some of the charges and he will almost certainly do more time if he goes to trial. If Teresa were to take a plea, however, she would be the one making a sacrifice for her family. I’m glad she has an excellent and properly experienced attorney to help her evaluate whether that is a sacrifice she should make. JMHO and sorry so long!

Thanks GPM for your informative and intelligible comment. You have details I wasn’t aware of or didn’t remember and I also think many of your theories are dead on.

One of Teresa’s problems is that she’s not a good speaker which makes for a bad witness. She may be telling the complete truth regarding any particular thing but since she has a difficult time putting her thoughts into words, she doesn’t sound credible. To make matters worse, I think she also has a difficult time comprehending what’s being said to or asked of her. If she says the wrong thing because she misunderstood a question, when she realizes it, she sounds like she’s backpedaling or “lying.” Add on top of THAT, she’s being questioned by someone who’s trying to trip her up and/or someone who’s intimidating.

I have a similar problem for a number of reasons. my upbringing and now because of illnesses which have effected my concentration and also lyme disease which has effected me in many ways including neurologically. Oh how I can sympathize with Teresa. It’s also why I have such anger towards the others because they are exploiting Teresa’s weakness(es). Not only do I despise them for taking advantage of her… these are people who she should be able to trust the most… they are her friggin’ family! They were supposed to be her friends! Not friends from the show… REAL friends… forever-type friends! Okay, friendships end all the time… but to turn around and stab that friend in the back… to use things that their friend confided in them… to betray that trust… ugh… it’s unforgivable.

Geez. I always go off in the tangents. I was only going to reply with the first two sentences… what can I blame my rambling on… I know!! Teresa! It’s Teresa’s fault! lol… actually… in a way that’s true. It actually is her fault… and mine… because I like her. No one’s perfect but it’s what’s at the core that matters and I think Teresa is a good, loving soul. I don’t think Juicy’s a bad egg either. He has proven more than any of the other husbands that he really cares. He’s not fake… he’s not an actor… he’s not playing up anything for television OR most of all BRAVO! It’s from his heart and he really can get mushy sometimes and say really sweet, from-the-heart sentiments. Geez, I’m teary eyed. I feel so bad for their family. Okay… I’m done… for real this time… lol

One sticking point for me is the involvement of NBC/Bravo in the business ventures of each HW once she is contracted for a particular show. It seems to me each HW is required to engage in some sort of business enterprise/sponsorship/book deal and Bravo is definitely an interested party (i.e., taking a % of sales). I doubt most of the women have the savvy or acumen to broker these deals on their own without reliance on a Bravo team of managers…or the perception of such. I believe most of them thought Bravo was “taking care of them”.

The NJ franchise differs from the others in that all of the NJ women were virtually “ordinary” (unknown) women when cast and probably most of them did not know to seek out legal and accounting expertise from those specializing in the entertainment industry. I have said it before and I will say it again multiple loan officers were falsifying documents themselves. Several builders went down in flames here in NC because of this. T & J did not cause the collapse of the economy lackadaisical and greedy loan officers did. Who are employed by the banks.

Fame, didnt we read shortly after indictment that a plea deal had alerady been rejected? Hopefully their lawyers can revist it with the judge? 4 baby girls is alot at stake! Very upsetting.

      October 22, 2013 at 1:50 PM

Your exactly right, a plea was given to the prosecutor and he flat out rejected it. And the rumor was that they would pay restitution but do no time and he wasn’t having it. He believes that both of them where involved and want some time from both of them.

      • GPM
        October 22, 2013 at 3:30 PM

Or that’s what the tabloids said, anyway.

Of course, they also reported that the prosecutor said there would be absolutely no continuances — right before the judge announced a continuance! LOL

      • October 22, 2013 at 7:39 PM

Just because a prosecutor wants time from both of them doesn’t mean (s)he’ll get time from both of them. The prosecutor doesn’t hand out the sentence… in some cases it’s the jury, in others cases it’s the judge, but it’s never the prosecutor. So, if there isn’t a plea deal reached… the prosecutor won’t have a say.

Buck Henry… we have no idea exactly what the plea was that was rejected. Honestly, it’s not surprising that it was turned down if the rumor is true and that was requested in the plea. In any case, do you really expect him/her to say (s)he DIDN’T believe both were involved? After all… there ARE charges against both. How bad would a prosecutor be if (s)he said, “Well we turned down the plea deal even though we believe one wasn’t actually involved… and we don’t care if that defendant does or doesn’t do time.”

        Seriously?

Anyone want to pass the time — go to Twitter and search for TSIL — there is a while new bumper crop of eggs and accounts with 0-25 followers all with similar descriptions. Nice try Marco PR team. The ship has sailed. Now go away.

      • October 22, 2013 at 8:26 PM

I’d love to know what it is he does. He doesn’t have his contractor’s license any longer. I saw his website a while back… he installs pools, ponds, etc. and landscapes. This time of year the only thing I can think of that he could do would be basically bagging leaves. It’s dark at 5am and it’s dark at 7pm. Hmmmm… wonder what TB is doing 14 hours a day. Now that he’s read the book (or had someone read it to him), he’s had to face the fact that TSIL DOES poop! (I’d think most guys would be more grossed out thinking their wives were going to some fast food place to poop instead of using their own nice, clean bathrooms. Ewwwww. TSIL is just a twisted Messy. hehehe) Anyway… maybe he’s looking for another stripper who, he can fool himself into believing, doesn’t poop… or cheat?! Or maybe… could it be… she’s LYING? Not too difficult to imagine.

I can’t find the tweet that someone sent him but they commented that most of the people there were for the drawing. It was noted that his tweet was RT twice, also. Which it shows once but I’m not too familiar with tweeting and RT. Can eggs RT? Because someone commented that TB’s phony follower’s who are eggs can’t RT!

I just watch part two of the reunion or was that the Teresa Trial Show. The Fame Whorgas were such fakers.

    • October 22, 2013 at 2:29 AM

I watched my last NJ on Sunday — the part 2 lost episodes. Now I can officially be done with Bravo.

      • October 22, 2013 at 3:58 AM

Same here! It was actually really good to see part 2. I felt like I was watching the Traveling Band of Shit for Brains made up of Head Turd Caroline and the rest of the dung beetles. They literally would cower in the corner in a little circle thinking of things to say to Teresa so get some/any camera time. Kathy Wakile was hostile when mentioning Teresa’s dad. Teresa basically gave her the proverbial ‘go eff yourself’ and Kathy scurried back to the carny folk to lick her wounds, which I’m sure taste better than her cannolis. Then her brother tries to give her a lecture about staying out of his life. Um, who keeps approaching whom? On a serious note, I do believe that he commits intimate partner violence and sexual abuse on his wife. She wrote it out in her book. It happens more when women at preggers and I can likely guess that he MADE her have sex numerous times during her pregnancies when she most likely did not want too. Watching Teresa’s aloofness at their trivial attacks makes me think that she really has her act together. OK, these are reality TV people who really are not that real. But I feel like if my brothers came at me like that, iI would act the exact same way! I’d be like *eye roll* “whatever child, go cry to your mommy” and Joe did, he walked right back over to Caroline!! A woman who proudly never tried breastfeeding her kids. They sure are making up for it now as all the little piggies have got their snouts pushed up to the sow’s teats. Glad the shitshow is over.

Has to educate and teach the women of the world. just skank of an individual not acting needed.. slimy so happy attacking Tre when he was done he couldn’t contain himself.. Yes we survived it’s over…..

I have to admit something shamefully so … I would buy TSIL’s music over Snoop (whatever he’s called) … he’s horrible. Seriously 1st time I heard him tonight, how did he make it?

    • October 22, 2013 at 5:04 AM

Hahaha. You are so cute. I can’t speak for his later music and I’m not a rap fan but Snoop became big in the 90s. I think his first hit or at least the first one I remember was “Gin n Juice”. It was part of this whole Cali thing. Him, Tupac, Ice Cube, etc. And now I feel old for knowing this.

      • October 22, 2013 at 8:37 PM

And I feel REALLY old that you feel OLD for knowing THAT. ho hum

    • October 22, 2013 at 10:12 AM

I like the Snoop doggy dog. I don’t like his music, but he made it on his own so somebody likes it. He is a funny guy, and not a bad actor. Nothing could be as bad as tsil’s music. Please reconsider, mz! lol

      • October 22, 2013 at 5:25 PM

i was a junior/ senior in highschool around time snoop came on the scene. “whats my name” was his first real big song i can remember as well as the “gin n juice” – i actually dug his early stuff. ( of course back then i was 19 years old vs 38 now LOL) i now a days embrace the older metallica ( master of puppets is one of my fav albums) as well as white zombie, ozzy, ect. i like snoop and would listen to him over TSIL any day hands down!

      • October 22, 2013 at 9:39 PM

I don’t know any of Snoop’s music, but he’s hilarious.

    • MissMel
      October 22, 2013 at 11:11 AM

Yes, please reconsider! Snoop is a very generous humanitarian. When he is in town for his youth football league games, you would never know he wasn’t just a neighbor from down the street. Granted, his music isn’t for everyone. As a person though, you can’t get much better than him.

      • October 22, 2013 at 8:41 PM

Exactly. mzjules… don’t look at it as buying the music for the music but buying the music for who you’d rather support for being a better person. Snoop wins hands down over TSIL 24/7/365 (or 366 for leap years… won’t give TSIL a second, no less an entire day).

He’s definitely not a singer. Although he’s allegedly cousins with Brandy who is. I think he’s in an experimental phase from what I’ve been reading lately.

I just can’t get invested with this heavy stuff. It’s all very complex and it has nothing to do with any of us.
As far as the Whorgas and their associates, they insulted the intelligence of us, the viewers, and ruined a show that used to be enjoyable.

These legal matters are a very personal issue. I think Teresa and Joe should be given their dignity and be able to deal with this privately instead of having it play out all over the blogs.

When the time comes, we’ll find out how all of this will end, but until then I’ll just hope for the best.

I totally agree Teramusique. Just my opinion but it’s very depressing.

      • October 22, 2013 at 12:57 PM

        Me too!

I agree with gessie that Joe should man up, do the right thing, and make a plea deal. I do not, however, like the idea of this playing out publicly. I said before I felt Teresa, at this point in time, should have retreated away from the show and give her full attention to her girls and do her best to take care of them, under these extremely difficult circumstances. Her kids should be number one priority right now and no money in the world is going to substitute their need for Mom being there. Gia is on the internet and so is Gabriella. There’s no doubt in my mind that at least Gia knows what’s going on and what the possible consequences could be. Scary stuff for a young girl. So, for me personally, going forward I will hold my tongue on this issue. I wish nothing but the best for the Giudice girls – my heart goes out to them.

On a happy note, it is off to Cali for me early tomorrow morn!!! So excited – cannot wait! Ten blissful days – of course, it appears the “June Gloom” will be hugging the coastline but I do not give a fig. No amount of cloudiness can take away from the beauty of what is considered the American Riviera. Favorite places, favorite food, and favorite people – ah!!!!!

Have fun Jeannie. The weather was the same on last trip there but we still had a blast. There are blessings with every day. On our trip, it turned cold with light rain on the day we were to visit Universal Studio’s Theme Park but we went anyway. As we were walking in the gates it started pouring rain, so we found a gift shop, bought us some warm hoodies and waited for the rain to lighten up. To our surprise it stopped raining completely, but not before discouraging the crowds to stay home. We spent the entire day at the park, never having to wait in line for rides. We rode some of the rides 3 or 4 times before moving on to the next. That weather was a gift – no crowds, no lines, see and do it all in one day and my boys were asleep in the car before we made it out of the parking lot. BLISS!!!!

I hope you have a great time and all 10 days are filled with blessings.

        • October 23, 2013 at 3:18 AM

Have a great time in Cali Jeannie. I think it actually snowed here in Indiana tonight according to some of the Facebook posts I’m seeing. It’s 3 a.m. here and I am up with a tendinitis flare up waiting for the Advil to kick in and not in the mood to go look to see if its true 😀 I love snow, but, hey now…it’s October! Needs to hold off for a few more weeks!

          • October 23, 2013 at 9:28 PM

Hi Bree for some reason I thought you were in Arizona. Sorry to hear about your tendinitis, I have the same thing and it can really hurt. October is too early for snow. In Nevada we are having the most beautiful weather right now. Love the winters here.

            • October 23, 2013 at 9:47 PM

Hi Gloria! Ahhh…I sometimes wish I was in Arizona. I love Indiana, the seasons, etc., but it is horrible for allergy sufferers (which, OF COURSE, I am!). It’s really way too early for snow though!

Thank you… I was crying like a little baby last night…it hurt so bad and I was soooo tired. It’s been a long week. My dad has been in the hospital and I’ve been running around trying to take care of everything. He got released tonight and is doing very well. Thankfully…I woke up today and the tendinitis was better for a bit, but I now have broken blood vessels in my left eye. Doesn’t hurt and isn’t any big deal, but oh my…how pretty 😀 Then, TMI, but, I also started today. My arm is starting to ache again but am hoping to time my Advil so that I am able to sleep tonight, so I am holding off for a bit. To top it all off, my crazy sister went to the nursing home on Monday and my nephew is harassing my niece over furniture and stuff and tried involving me. I want to slap him sometimes… I had quite the “poor me” day today but believe it or not, my attitude is better now — I just wanted one last chance to whine 😀

I posted this elsewhere and thought it was absolutely hilarious, so I am going to share it again (sorry):

While we are on the subject of dogs… My dad was hospitalized Monday with suspected pneumonia and it turned out to be just a lot of mucous in his lung with no infection found. He was released this evening and as the nurse was helping me get him into the vehicle, she started laughing and asked me if my boys have 2 legs or 4. Turns out, Dad had told the dr. he’d rather go home tonight rather than tomorrow since there was no big reason for him to be there and that I was having to work, take care of my mom who has Alzheimers, visit him AND take care of my little boys. The dr. asked how big (or old, not sure…) and dad said, “Oh, I guess 15 – 20 lbs.” When the nurse was helping me, she saw the dog car seats and harnesses and asked me if my boys had 2 legs or 4 and explained that they thought I had twin baby human boys. 😀

              • October 23, 2013 at 10:01 PM

That’s too funny Bree. We have three dogs all recued. Glad your Dad is doing good. Sounds like you have your hands full. Hope things settle down for you.

                • October 23, 2013 at 10:43 PM

I have two Havanese (Cooper and Bentley BooBoo). Not rescues, but I admire those of you that choose to rescue. I have in the past, but my last rescue got cancer at age 5 and, emotionally (and financially) I didn’t want to chance it on the background at the time. My son just rescued a little 6 lb. Maltese recently…my adorable little Petey. What breed are yours? I just love, love, love dogs. I’m “kinda” crazy dog lady. I want a little girl Havanese soooo bad. Hubby will not allow it though. Truthfully, it’s probably the last thing I need 🙂 These two are rotten. They are good little boys though, thankfully.

Thank you Gloria. It’s been a hell of a last few days but things are looking up!!!! I really don’t have it too bad and just feel the need to be a bit dramatic sometimes! I will be back on a fairly normal schedule tomorrow and that will help out a lot. I truly think I have OCD (not the compulsive part) and have been a little out of sorts lately anyway — hubby has started hunting and that has thrown a big wrench into my routine — I was just beginning to realize what my deal likely was and was starting to adjust and then, BOOM, total loss of control over everything. The good thing is that I realize it and can somewhat calm myself down after allowing myself to wallow & whine a little bit.

Enjoy your beautiful weather…that boot and sweater weather that I had been wishing for is definitely here!!!

Joe doesn’t get to choose whether he takes the fall and leaves Teresa out of anything, Teresa is being prosecuted for things that are independant of Joe, like concealing her income from Skinny Italian and TG Fabulicious in the bankruptcy filing. Teresa needs to be treated equally and independantly for what she’s charged with, that’s how justice works.

    • October 22, 2013 at 1:44 PM

Justice works however the heck the lawyers want it to work.

      • October 22, 2013 at 2:07 PM

Very true. And don’t forget to include the judge in that as well. Very little of “blind justice” where there is no outside influences and decisions made based solely on facts and evidence, exists anymore. Alot has to do with agendas, personal stakes, and what is in it for all the parties involved.

Very true. How many rich white folk are on death row? It’s only poor people who can’t afford expensive lawyers. Justice is not blind.

        • October 23, 2013 at 11:07 PM

          Justice is self serving.

    • GPM
      October 22, 2013 at 3:18 PM

I think they were indicted and are being tried together because two of the three general areas of dispute — the bank loans, the bankruptcy filing — were joint. But I definitely agree that each will have their own defenses. (And, of course, only Joe has been charged with respect to the unfiled tax returns).

Tying them together gives the prosecution leverage over Joe.

But since the fact that Teresa is a celebrity is the reason they singled them out for prosecution in the first place, the DOJ is unlikely to enter into any plea negotiations that don’t look like they got their pound of flesh from her personally, no matter how innocent she may be.

I think Caro was so scared b/c this took place at Kim D’s party, and I believe Caro is scared of her associates..just a thought.

        October 22, 2013 at 6:58 PM

That, but also she would have no control over what was said or blurted out,, and we all know that rumors about her husband cheating were brought up this season. I think she was trying to keep her business from appearing on camera, if there were to be a confrontation. She sent TB over to Teresa (even though she thought she was being clever), so she helped to instigate that confrontation concerning Teresa, so she didn’t care if brother and sister had words. She was more concerned that everyone would see her role in it, and bring up her business on camera. She couldn’t get everyone moving fast enough to get out of there, and it wasn’t because she was concerned about a brawl and their safety, as the other brawls did not occur until after this event. She had been really shitty to Teresa, and then showing up with Teresa’s family to this party–she was afraid that someone was going after her, especially since it was an event given by Kim D. There was a reason she was attacking Kim D. in the finale, and the rumors probably started early in filming about her own relationship and her family. Since she already knew that TB attacked Teresa verbally in the gym, she was instigating trouble to tell TB that his sister was there and to do want he wanted to about it. She didn’t care if TB said shit to his sister, she just didn’t want it to come back and bite her in the ass–Teresa sitting alone with friends, and Jacqueline and Caroline sitting there with Teresa’s family. Really?? She knew there was already looks and talk just because of that, and people would be angry with her for treating Teresa that way. I bet that a lot more was said and done at that event, that also went on the cutting room floor.

        • October 22, 2013 at 8:35 PM

I think your right. I noticed that there was a rather tall, male, standing about 2 tables away from the table Caro and company were sitting at. He looked right at the table, hands held together in front of him when Maria approached their table. He was wearing all black and had some glasses on, dark tinted, I do believe. I think Maria, being young, pretty and speaking Italian may have some connections. TB was quick to apologize and TSIL only asked TB, (paraphrase), “Did you yell at her?” and TB admitted he did and apologized. IDK, but when Maria said something about Richie it seemed like she singled him out for a reason. Caro was quick to get the H out of there. She didn’t come across as her “Know it all” self, she came across as worried.

        • October 22, 2013 at 9:12 PM

I agree isolde. I didn’t actually see it but from all I read, it sounds right IMO. It would also make sense as to why she isn’t coming back. She was starting to feel the heat and as Kathy says “if you can’t take the heat… get out of MY kitchen.” So fitting… don’t let the door hit you on they way out Caroline. Now if only someone would light a fire under TSIL’s a$$…

Nicely done, Ms. Gessie! I also applaud you for opening up so courageously about your own family travails. You are an amazing woman and I always enjoy reading your comments. Sending you and your precious canine companion a whole boatload of love!

  13. October 22, 2013 at 11:23 AM

Thank you Honnie! My precious pooch was up all night vomiting and so I had to stay home with him like a sick child. Funny that you should send love his way on this day when he really needs it. You must have telepathy. As for the Guidice case, I stand by what I said. Juicy has the power to save his wife. If people don’t think that plea bargains are the most desired outcome in these situations, they are sadly mistaken. Unfortunately, we are dealing with someone who thinks he has female eggs, so we will see. But I hope he will be a man about it.

      October 22, 2013 at 11:32 AM

Joe does not have the power to save Teresa, if the prosecutors want to go after Teresa they will, no matter what Joe does. Joe can offer a plea deal, and there are sources that he offered exactly what you stated, which is that he will plead guilty and keep Teresa out of it, and the prosecution rejected it. The prosecution will decide any plea deals, and the sources say that they want Teresa to serve time, too.

      • GPM
        October 22, 2013 at 3:09 PM

Actually, bobby, the prosecution doesn’t “decide” plea deals, either — it’s the judge!

Both sides do generally try to negotiate something that both sides can agree to and the judge will generally — but not always! — adhere to that agreement.

But if there’s a sticking point that neither side will budge on, it’s off to trial we go!

        • bobby brown
          October 22, 2013 at 4:23 PM

The prosecution has to decide if they will offer the plea deal, not the other way around. Joe doesn’t have the power to tell the prosecutors what plea deal will be offered to him is my point. Yes, of course the judge has to accept the deal, too.

          • October 22, 2013 at 9:55 PM

Either side can make an “offer” a/k/a plea. Neither side can force the other to accept the plea. They can and will usually negotiate to try and come up with something that both sides find acceptable. The judge will always have the final say. The judge isn’t involved in the negotiating. It’s rare anyway… but in most jurisdictions, the judge is never involved in that aspect.

It seems to me that more often than not, it’s the defendant who’s not willing to negotiate… because they ARE innocent and won’t admit to guilt under any circumstances. This is an assumption… I’m not claiming to know this to be true.

In any case, I agree with gess… plea deals are most often what’s strived for. Not only does it save time and money, but juries are unpredictable. There’s really no such thing as a “slam, dunk” when it comes to a jury trial. For either side to think that way is a dangerous thing. There are those who are truly innocent yet still take a plea deal because of this FACT… you can never be certain of what a jury will do.

gess… so sorry to hear your pooch was sick… I hope he’s feeling better and everything’s okay. Hugs and kisses to him!

I am so happy your precious baby will be just fine.

            • October 23, 2013 at 9:21 PM

Sorry to hear about the flu, but happy he is doing better.

I thought I read somewhere that Teresa and Joe tried to offer a deal that would have Juicy serving time and charges dropped against Teresa but it was rejected? I think the feds are going to go after both of them no matter what, sadly.

    • October 22, 2013 at 1:07 PM

In Touch reported on August 15, 2013 that the U.S. Attorney’s office has rejected Teresa’s attempt to make a plea deal to avoid jail time:

“They were originally going to plea down for Teresa, but the U.S. Attorney’s office said no,” says an insider close to the case. Teresa’s attorney, Henry Klingeman, said, “I’m not discussing it. If there ever were a deal, I would never discuss any conversations with the government about any client.”

However, a second source says that a plea deal was definitely discussed by Teresa: “I have never seen any kind of case where that hasn’t happened. And discussion about a plea deal took place here.”

Both Teresa and Joe will face up to 50 years in prison if found guilty, with the possibility of Joe’s deportation.

I’ve posted occasionally, but I have felt like a member of the fame family for a while.
My personal family circumstances have always framed my opinion of the Gorga family saga. Largely because I view the Gorga parents as loving individuals. I may be wrong, but I haven’t felt a hint of inauthenticity.
Their inability to disavow their son publicly after their house disaster has always made me think they loved their son despite the deep hurt TB and wife must have caused them. Let us not forget the public trashing of their daughter who cannot defend herself for fear of embarrassing her parents.
It takes so much love for a sister and her parents to maintain even this level of a facade.

Sadly, my father was a douche, which legally I don’t think I’m allowed to say… but hey… this is my Famewhorga name (hope I don’t get sued again)…..

The point Im trying to make it that there is REAL love here and REAL history…. not the forced, lets play pretend type. I respect the elder Gorga’s and T for that.

And I feel a deep shame for TB for not realizing that he was lucky enough to be born into a family that is deeply loving.

I would be so ashamed to have been granted half this much and to toss it away.

Completely, agree with you Smith. TB should be ashamed, but he and TSIL show no sign of feeling that way. They only choose to blame Teresa for any turmoil within their family. It also angers me that they know that the Gorga parents and Teresa love TB so much, and they take advantage of that love and continue to wreak havoc in the family. Truly despicable.

      October 22, 2013 at 3:09 PM

I feel you on this Smith, as you have probably read he would make me so angry that I literally had to stop watching and pull away from the Gora saga. My blood pressure would go through the roof. I actually hated him and his wife for what the did or what I perceived that they did on the show.

One time I was at the doctors office angrily posting on my phone. When they took my BP is was 189/80, my Dr. asked me was I upset over something. I was too embarrassed to say it was because of this HW show. I have weaned myself from the HW teat but it does not stop the sadness when I look at wreckage he has left his family in. Even if I don’t watch anymore its still all over the airways and internet.

I never knew my father, my mom’s second husband adopted me when I was very young. They divorced when I was 10. She wont talk about my real father even to this day. Which has left a void in my life. He has no idea how blessed he is to have been brought up with a mom and dad that love him. He is also making his children miss out on a loving relationship with their grandparents, not to mention their traditions and language. Maybe one day he will realize that before it’s too late.

      • October 22, 2013 at 4:53 PM

Have you ever considered a DNA testing site? Quite a few of my relatives on 23andme are adoptees looking for family. I know I’ve read stories of people finding parents and siblings. I can understand however if you want to keep the door closed. It’s just a thought.

genealogybank.com has old newspapers that you can put in a search and look thru. I found that one of my husband’s great uncle who disappeared off the tree was killed when his train hit a bull. Another was my great grandpa winning proses with his chickens. It costs around $60 for a year of unlimited use. I also have been on Ancestry.com for yrs and found many people who have shared info including photos.

              • October 27, 2013 at 3:20 PM

That is so cute about your great grandpa! I’m trying out Ancestry.com right now for a little bit. Filling out my tree and then deciding if I want to keep the account.

Newspaperarchive.com is another one that has old newspapers. I collected a ton of obituaries that way. Morbid, I know but very helpful. Looking at genalogybank.com right now. That one’s new to me.

omg why am i not shocked she is trying to be the focus of attention, even over her own daughter?? sandra bullock gets it right (w her mom/son matching costumes but of course sandra is a totally different league than what TSIL can even THINK to be in)

    • October 22, 2013 at 7:15 PM

I dunno, I think it looks cute. It could be worse and TSIL could have the real wonder woman costume one (I mean without the skirt)

      • October 22, 2013 at 11:14 PM

I have to agree with you – this could have been much worse. Back in the days of Underoos (yeah that long ago) my mother with a stick figure bought herself some Wonder Woman Underoos , big plastic boobs and boots to wear to our school Halloween festival. I was in 5th grade and it was so embarrassing. My parents were divorced and the festival fell on our weekend to visit her. I never said a word because I didn’t want to hurt her feelings. She did put a lot of effort into it and looked nice but did she have to wear it to my school? Years later – the subject came up and still she had no idea how inappropriate that was. She thought she had dialed it down to school appropriate – WW was a Saturday morning cartoon superhero. She laughed and took out the adult party pictures from that same year and she turned those Underoos into a slutty Wonder Woman costume complete with a Superman Underoos wearing hairy step dad. EEEEWWW!!!! All I could say was thank goodness she didn’t bring him to my school.

Would you want your mother to go to a party looking like that. How would you feel if another parent came to a school function dressed like she is. Antonia’s skirt comes to the knee, not TSIL. Of course we don’t know where the party was held or if there really was a party, could’ve been a photo shoot. If it was a child’s party I feel it is inappropriate attire.

I am very close with a retired fed prosecutor and this is how he sees it after reading all the charges… Teresa WILL do jail time, there is no way the Feds will allow her to walk without jail time. Parents go to jail all the time, the Feds don’t care. Cong. Jesse Jackson Jr. And wife both sentenced for much lesser crimes. They brought their two children to court during sentencing and cong. Jackson pleaded for house arrest for his wife because of the children. The judge replied they should have thought of that before committing the crimes. Mrs. Jackson got 1 year.
The Feds will treat Teresa and joe very harshly because they are famous to make a statement to all of us that we should never lie to the govt. Teresa is exactly right when she says they are being held to different standards because of their fame. They have her dead to rights on these charges or they wouldn’t have brought them and she knows it. Rumor has it and he believes it, that they tried for a plea deal where joe would do all the jail time and she would do house arrest. The Feds through it back because they are insisting she do time. They have her signature (verified) on loan apps with fake W2s and pay stubs. They have her in open court lying under oath about her income. This is my friend talking, not me. So as far as the IRS and the dept. of justice goes, you could be a single mother of 20 kids and they will still put you in prison if found guilty. They don’t care. And just think, with obamacare, 6500 more IRS agents are being unleashed upon us.

    • October 22, 2013 at 10:15 PM

Wilbur, I was with the court system for over thirty years. Some of our district personnel went on to the George Arceneaux, Jr. Federal Courthouse. I contacted one of my friends today. Only prosecutors can offer a plea deal. The defendants may offer to cooperate and then a plea deal is offered, which must be approved by the judge. Since this case has been continued already, my friend believes it is still in discovery.

This all started in four years ago, if this case were so “dead to rights”, the charges would have been brought on much sooner.

As I have stated before, Federal Court prosecutors are appointed.

      • October 22, 2013 at 10:17 PM

Oh, Wilbur, please present to your friend what I have stated. Let me know what they say.

      • Wilbur
        October 23, 2013 at 1:40 PM

Dead to rights meaning they took their time, crossed their Ts and dotted their Is. This is his opinion, not mine. He spent 30 years working on prosecuting similar crimes and this is his take. Don’t beat up the messenger please! The Feds hate to be lied to and they will use her as a poster child to teach all us nobody’s a lesson. It’s not fair but who said life was fair? Anyway, thought I would share his thoughts. I would give money to make this Melissa’s problem instead of Teresa’s, but it is what it is.

Fed prosecutors are not political animals. Remember the trouble bush’s Ag got into when he fired all those attorneys? There are hundreds of prosecutors who are civil servants who serve in the justice dept. and they work on these cases. They SHOULD be independent of the WH. By friend was not an appointee, he was a civil servant.

          October 23, 2013 at 3:56 PM

Yeah, I think it is Tamar. I didn’t notice that at the bottom of the article, it mentioned something about a “new family” which would possibly mean a new baby.

The whole, nose job, husband punched her, husband wants all the attention and jealous of wife’s attention bit really sounded like it could be them. Seems to me that whoever it is, isfollowing the advice in Melissa’s book!

          • October 23, 2013 at 6:24 PM

Sad. He seems like a big teddy bear. Tamar acts tough but you can tell she’s a softie. I look like a softie but anyone who starts a fight with me usually ends up in tears. Domestic violence makes me so angry because I know it’s hard to walk away but if you don’t do it, it means you don’t think your life is as important as your abuser’s. My grandfather tried to hit (or did, the story changes) my grandma once. That was the only chance he got because she took the kids and left.

Yes Bobby, I thought I read that they had to surrender their passports.

    • October 23, 2013 at 2:03 PM

Most likely the terms were set for their unsecured bail bond.

“A defendant on bail is free to travel out of state or even out of the country unless the court has set specific requirments that the person is not to travel. In most cases the geographic restrictions will be very specific as to where the person can and cannot travel. Some courts will require the preson to surrender their passport if it is belived that they may leave the country and not return. ” http://www.avvo.com/legal-answers/can-a-person-leave-pa-on-an-unsecured-bail-bond–557587.html

It was reported that Teresa and Joe did have to surrender their passports and that they were restricted to travel within NY or NJ unless it was pre-approved travel for work, which is how they got to travel to Miami. I am curious about Italy and when exactly that trip is planned.

With all due respect to the commenter who is quoted in the original post, Joe Giudice doesn’t have the power to work out a plea deal to save Teresa from jail time, that is up to the prosecution. I believe that Joe is willing to take the fall and spare Teresa from any sentancing, and I think both he and Teresa are expecting this to happen, because they keep acting as if Joe will be going “away”, but the possiblity that Teresa might go to jail, too, doesn’t seem to be acknowledged. I have no doubt Joe would do that for Teresa, but I don’t think the prosecution is willing to offer this kind of deal, I think they are going to go full force against both of them.

  27. October 23, 2013 at 11:15 AM

I want to find out what exceptions the INA recognizes. Anyone know?

“Under the Immigration and Nationality Act (“INA”), a noncitizen convicted of certain crimes classified as an “aggravated felony” offense is deportable.

In Joe Guidice’s case, the amount of the alleged tax fraud is nearly $1 million – more than enough to reach the threshold of an aggravated felony, which includes tax evasion with revenue loss to the government exceeding $200,000.

    But deportation is not automatic.

Before the Guidices go to trial, the United States Attorney must file a notice of intent to request judicial deportation. At least 30 days prior to sentencing, the United States Attorney must also file a charge setting forth the citizenship of the defendant and identifying the crime that makes the defendant deportable.

If the defendant is convicted, the court may order deportation at sentencing if the Attorney General demonstrates that the undocumented immigrant is deportable under the INA. The INA recognizes certain exceptions to prevent the removal of an otherwise deportable noncitizen in compelling cases. However, it is not yet clear what, if any, exceptions would apply here.”

Just to make sure we here, at least, stay on the straight and narrow, Joe isn’t charged with tax fraud.

Counts 35 through 39 are for “Failure to Make Tax Return,” i.e., failure to file. The nearly $1 million in income referred to is what the IRS calculates Joe earned over the five-year period from 2004 to 2008.

Where people can get in trouble for tax fraud is when they file a return and deliberately leave out substantial amounts of income. (The 3,000-plus taxpayers who stashed multiple millions in Swiss bank accounts, for example — you know, the ones the DOJ didn’t criminally prosecute and who were only required to pay the back taxes and a penalty.)

Failure to file a return has historically only rarely been prosecuted criminally. Someone here commented on blog last week and provided a link to the list of criminal prosecutions the IRS had engaged in for the year. There were 186 prosecutions on the list, but only one involved the failure to file a tax return. (That involved a group of individuals were systemically defrauding prisoners and their families by getting them to pay large amounts of money for appeals “research” that wasn’t being provided and the proceeds of which activity were not being reported on anyone’s tax return.) The remaining 185 cases involved circumstances where returns were filed that excluded income that should have been reported but was not.

Failure to file, moreover, is by law a misdemeanor and not a felony; in order to bump a failure to file up to a felony the DOJ will have to prove that there was an overt act of evasion. (Notably, the President’s Budget for 2009 contained a provision that would make repeated willful failure to file a tax return a felony so we may see more felony prosecutions in the future but, to the best of my knowledge, this hasn’t yet made it into law. It would in any case never apply to Joe Giudice since the charges against him are for tax years 2008 and earlier.)

Joe Giudice’s situation is similar in this respect to that of Wesley Snipes, who also did not file tax returns for a number of years. The Snipes indictment also charged him with a felony but the DOJ was unable to carry its burden of proof and Snipes was only convicted of misdemeanor failure to file.

      • October 23, 2013 at 12:29 PM

Thank you for clearing that up. You explained it very well.

      • October 23, 2013 at 12:52 PM

        That’s a great explanation! Thanks 🙂

      • October 23, 2013 at 1:21 PM

There are so many false accusations and embellishments out there it is good to hear from someone who knows what they are talking about.

It’s also quite interesting to note that some of the indictments refer to construction loans originated by Park Avenue Bank. Now if there ever was a shady, crooked bank – they were. Were in the sense that after the president of the bank was *convicted* of fraud and the bank shut down by the Feds – they were absorbed by Valley National. One of the only convictions on record of a bank executive on fraud charges. Park Avenue was a very sleazy bank. I have my suspicions that it might have been the Guidices financial relationship that started the Feds looking at them and not the Bankruptcy. They could have had extremely advice from counsel during the BK and that would not in and of itself lead to fraud charges. But dealing with a known crooked organization will get the ball rolling…

I suffer from this travel condition, which makes me want to live in the places I recently visited. A month ago I wanted to live in New York. However Porto Venere is still on my mind. I tell myself we will more there when my husband retires. It is the only place that continues to draw me. No automobiles, the Sea of Poets, great people, great food, I could go on and on.

With respect to deportation, the grounds upon which a legal U.S. resident can be deported are listed here:

      http://www.nolo.com/legal-encyclopedia/grounds-deportability-when-legal-us-residents-can-be-removed.html

Crimes that will make an immigrant deportable and waivers are discussed at:

      http://www.nolo.com/legal-encyclopedia/crimes-that-will-make-immigrant-deportable.html

If Joe is convicted of felony fraud in both the DMV case and the federal case, he will have committed two fraud offenses. Since fraud is an aggravated felony, I don’t think either one would be eligible for waiver and, as a result, he would have committed the two felony offenses and that would make him deportable. JMHO of course and I am not an expert in this area at all!

From what I understand from this data, Teresa was released on an unsecured bond which is “normally used only for misdemeanors with defendants with fairly clean criminal records and no problems with their credit history”

Joe Giudice, 43, who is from Italy and not a United States citizen, was released on a $500,000 bond secured by his father, Frank, and Teresa Giudice, 41, was released on a $500,000 unsecured bond. http://abcnews.go.com/blogs/entertainment/2013/07/joe-and-teresa-giudice-released-on-bond-lash-out-at-reporters/

Unsecured bail bond. In this case, the defendant signs a contract that may include a 10 percent non-refundable fee to the bail bonds company. The company agrees to guarantee the entire amount of bail based only on your signature on a contract agreeing to return to court for any required appearances. This is normally used only for misdemeanors with defendants with fairly clean criminal records and no problems with their credit history. http://www.superpages.com/supertips/no-collateral-bail-bonds.html

I worry about everything I put in my boys’ mouth…I lost a dog to a rare form of cancer — the only common link they could find was poor diet. And I had her on what I was led to believe was a good food. I highly recommend dogfoodadvisor.com. I feed my boys commercial raw and they get veggies as treats. I can’t believe how bad some (a lot) of this commercial dog food is. And that it is still on the shelves. Also can’t believe all the stuff that is sourced from China and how they don’t have to report where their ingredients (ALL of the ingredients) are sourced from. Buyer beware…

Don’t feel like that Bree, so glad you posted this so many people are aware of the dangers. I worked in a Natural food co-op, a lot of people are afraid to use pet food and make their own. I am seriously thinking about making organic doggy treats at the bakery. It is a high demand for them.

          • October 23, 2013 at 11:18 PM

I want to start making my own as well, I’m just afraid I will do it wrong and they won’t get the proper nutrition. I guess I need SPECIFIC recipes and feeding amounts. I’ve checked for local raw food co-ops but none close, last time I looked. I wouldn’t know the first thing about how to start one either. For the time being, I’m satisfied with the commercial raw I am using. I know I could do it a lot cheaper myself though. I’m not so into throwing them a big hunk of something to drag all throughout my house so I would have to grind everything, etc., so I would definitely need to be sure I was committed to it.

Do you own a bakery? I think that would be an awesome idea. Not sure that it would be a good sole source of income in our area, but if you already have a regular bakery, I can see that doing well as an add on type of business. Heck, I don’t even know what the regulations are (if any) for pet treats but could you even do a mail order or Etsy shop type thing? My Cooper is low-carb, so neither of mine get “treats” per se. Treats to them are carrots and green beans and if they are really lucky, asparagus. They love their veggies!

Do some stuff on the side for friends and family out of a commercial kitchen we call it the bakery, lol. I knew it, China! These companies don’t care what they do to our beloved pets, it’s just a quick way to make money. US companies shouldn’t use these cheaper products from there to put into pet food. Something like this happened to the baby formula a while back. What some people do for money, it’s just awful.

I read this earlier and am frantic. I use purina one for my kids, both felines and my pup and nowhere on the label does it mention china but now I don’t trust them. Blue Buffalo seems like a great product but I can’t afford it right now. Not sure if I should stop using purina products because like you guys, my pets are like my kids (almost) and I can’t bear losing them.

Wilbur, go to dogfoodadvisor.com and check the rating on your food. Also, to the left they have categories such as Dry Dog Food, Wet Dog Food, and Raw Dog Food — you can click on that and it will give you 5 Star, 4 Star, 3 Star, 2 Star and 1 Star. Go there and look and buy the best rated you can afford. They go through the food ingredient by ingredient and the ingredients in red are bad and they explain WHY they are bad.

I didn’t see any grocery store type dog foods in the dry category until the 3 star and below ratings, but then again, I am not familiar with all the foods that you can purchase at grocery stores either. Like I said, just purchase the best you can afford. If there are a few on your list that are similarly priced, evaluate the ingredients against each other and decide from there.

Regarding the labeling… I could be wrong on this but I don’t think I am. I don’t think the FDA requires manufacturers to list where all of their ingredients are sourced from. For example, they could purchase one ingredient from a US supplier that actually sources from China. The company I purchase from sources only their rabbit from China so I stay away from that. And they are upfront about that and it is on their website. Another thing that I don’t like is that they can change their formulas and don’t need to publicize that. I had mine on a holistic food for awhile and the packaging changed so I checked into it, and sure enough, they had made some changes so I went to another brand. My boys are small, so I am more easily to afford feeding them a premium raw diet but I know that not everyone has that luxury. It is expensive enough with mine being little guys and I am seriously considering making my own! The video that black enga posted above looks to be a very affordable recipe!

Please forgive me for being repetitive…I get a little fired up about this. 🙂

And one more thing, always look in the comment sections when you go to these sites…there are sometimes a lot of valuable information in there just like the comments we see here on the Fame blog!

Does anyone remember why Teresa and Kathy went to Boston? I was wondering if they both were working with this group.

    http://www.bcg.com/media/pressreleasedetails.aspx?id=tcm:12-141806

I was also wondering is Teresa going to Italy to check on her production company, it seems like its very lucrative to import goods from there and sale them in the US.

Gessie this ones for you, I hope I win the lottery, I’m like gone to Italy in sixty seconds.

Fame, there are far worse cases in New Jersey than Joe & Teresa Giudice. Here’s one example.

    http://ind.gmnews.com/news/2000-03-17/Front_page/f09.html

If you read about this man, he defrauded $40 million from his investors. Nobody knows how much he really lost, or what he did with the money. After being convicted, he served just 5 years of his 10 year sentence.

Now he’s the number one realtor in his county in New Jersey. I often wonder how his victims feel about that, or if they have ever received any money back from their lost investments.

IMO, the Giudices have not done anywhere near what this man did.

  37. October 27, 2013 at 1:01 PM

Here’s another person that did far far worse than anything the Giudices ever did. In fact, the FBI investigated his shady businesses, bribes, crimes etc. known as “Operation Bid Rig” for years. After the FBI spent millions investigating this major crime kingpin, the mayors & other officials convicted of receiving bribes, nobody really served that much time…..or paid the gov’t much in fines. Sometimes I wonder if it really was worth all the effort & money that we, as taxpayers ultimately paid.

What you will read on the internet barely scrapes the surface of all the things this guy was involved in. He received 1 year in prison and then house arrest.

    http://www.bretschundler.org/bret05/news/ce050405f.html

In comparison, the Giudices have done very little. Is it fair to send them to prison for 50 years and be responsible for God knows how much in fines? Compared to the 2 people I’ve cited, the answer is clear.

Dina’s ex-husband (Tommy Manzo, brother of Albert Manzo who’s Caroline’s husband) put a hit on one of Dina’s boyfriends in 2015 and then ordered a home invasion in 2017 where Dina and her boyfriend (now her husband) were tied up and beaten. Caroline still supports the Manzos and not her sister.

Dina’s ex-husband gave a mobster a discounted wedding reception at the Brownstone for breaking into Dina’s house to beat up Dina and her new husband. Caroline has written a letter to the judge in support of Dina’s ex-husband (Al’s brother).

At the time, Dina and her boyfriend were living in California, where they currently reside, but were visiting their home state for the First Communion party for Dina’s goddaughter Audriana Giudice.

Kim DePaola figures it had to have been ordered by someone who knows Dina. “They were only home from California for two days for the christening. Isn’t it kind of a coincidence that the home invasion happened then? Who else but people in Dina’s circle knew they would even be home?” said DePaola. “That type of burglar does a little homework. That house had been empty.”

Dina and Cantin got on a plane right after the 2017 attack and, as far as DePaola knows, haven’t been back to Jersey since.

“Dina’s been through a lot and I think she’s been scared s–tless by everything that’s happened,” DePaola said. “You know what? She was a girl looking for love and she finally found it.

“Tommy didn’t want her until she was gone. It’s his loss. She came out ahead.”

    happyme005

There was actually two separate incidents. In 2015 Dina’s then boyfriend (now-husband Dave Cantin) was followed and ambushed in a strip mall parking lot with a slapjack by John Perna, who is part of the Lucchese crime family. This was the incident that John Perna received a steep discount for the wedding at the Brownstone for. Many of the 330 guests at this wedding are part of the Lucchese crime family.

The home invasion happened on May 13th, 2017, where they tied both Dina and Dave up with zip ties, kicked, punched, and beat them with baseball bats, and stole Dina’s $60,000 engagement ring plus some cash. Dina needed reconstructive surgery. They told her “that’s what you get for fucking with a guy from Paterson”.

It’s absolutely frightening and Caroline should rot in hell for turning on her own flesh and blood for a bunch of low-life’s like the Manzos. She gets all her imaginary power from her husband’s crime family.

Albert’s father, “Tiny” Manzo, was one of the biggest mob enforcers in New Jersey for the Genovese crime family. He was murdered a year before Al and Caroline got married. He was stripped naked, tied and gagged, shot 4 times in the chest, and stuffed in the trunk of his car. His arms and legs were wrapped in plastic.

Before his murder, Tiny and another guy, Gambino family soldier Peter Campisi, were accused of skimming money from a mob casino on Staten Island. Campisi was murdered the same way as Tiny Manzo in the same period of time.

The Gambino crime family were known for the gruesome way they disposed of the bodies, which became known as “The Gemini Method”. Part of this method consisted of draining the blood out of the body, wrapping the limbs in plastic, and dismembering them.

Since no one was ever found guilty of these murders, there’s a couple of scenarios that are likely. Either it was the Gambino family that murdered him and the dismemberment was cut short for some reason, or it was another crime family that wanted to “point the finger” in a way towards the Gambino crime family, take the heat off of themselves, and were never planning on actually dismembering the body. Tiny weighed almost 400 lbs and he barely fit in the trunk of the car. In fact, they had a really hard time trying to remove the body.

Another interesting tidbit is that Tiny’s wife, “Nina” Manzo, took out the life insurance policy on Tiny shortly BEFORE his actual murder. She was never able to collect the money though. Her case went all the way to the Supreme Court and they ended up denying the release of the funds based on the fact that Tiny lied on the application about having Diabetes.

Sooo fascinating and I wish it was way more of a discussion on the New Jersey series, but I’m sure everyone is afraid of the same fate as Dina or worse. There’s a really interesting book by Mike Russell and Patrick Picciarelli called “Undercover Cop: How I Brought Down the Real Life Sopranos”. I would definitely recommend it if you’re interested in stuff like this.

“RHONJ” star Kim DePaola says there is a reason Dina decided to leave her husband. “[The divorce] is not on Dina, it’s all on Tommy,” DePaola told The Post. “Dina was madly in love with him and she sat home every night waiting for him. She was a good wife. He was off at The Brownstone doing his thing, if you catch what I’m saying.”

Tommy Manzo allegedly “did his thing” with so many women that Dina once confronted one of them, who told her to “take it up with your husband,” DePaola said.

So what happened to make Tommy go after Dina’s new guy, as the feds believe?

“Here’s the thing, Tommy is actually not a bad guy,” DePaola said. “He’s mild-mannered, very lovely to people at The Brownstone. I think it was a man thing. They want what they can’t have. He didn’t want Dina when she was starving for attention and was dying for his love but when she leaves him and goes off with a new, younger guy? His ego couldn’t take it. He got too wrapped up, that’s my take.

“It’s hard not to notice that her new guy looks like a younger version of Tommy. I’ll leave it at that.”

As for mob ties, DePaola added that neither Albert nor Tommy are “in the life.” She also said their dad was not a “full-on gangster” but was killed after he “did something the full-ons didn’t like.”

“When you’re a full-on you have to abide by some rules and regulations of the life,” DePaola said. “From what I know, [Tiny] maybe did something that was not following the rules the full-ons had to follow and they wanted to send a message.”

This is more of a story about Tommy being an asshole than Albert, but I met both of them when I was a bridesmaid in a wedding at the Brownstone. The wedding party was getting dressed before the wedding and the bride’s 14 year old sister was in the bathroom changing. A man ran into the bathroom, busted open the door and told the girl to get out, he was the owner and had diabetes and had to pee immediately. He was literally unzipping his pants while the girl was trying to get out of the bathroom. She was very upset and we complained to the wedding coordinator. Eventually, a very obviously strung out Tommy came in to apologize saying he has diabetes and it causes him to have to pee frequently. It was completely horrific. That poor girl was traumatized. After a while, Albert came up when he heard some of us were housewives fans and chatted for a while to smooth things over. He was very friendly, but the damage was done.

I love how Caroline also insinuates that her connections to law enforcement were somehow proof that she was not involved with organized crime. It’s a well known fact that the two are one in the same in Northern Jersey. Many of the old crime families now have family in law enforcement. It’s been that way for decades.

Don’t forget Dolores is friends with Caroline too.her father was the chief of police in Paterson. Damn, Dolores.

Got another one for you. Since Kim D is kinda friendly with Caroline, one year she thought her son was burned to death in his car but it turned out to be his best friend. Turned out the guy who burnt the car was an enforcer in, get this, VITO’S FAMILY. The same Vito that is married to Lauren Manzo.

Danielle is her own brand of crazy, which I love by the way, but they were horrible to her. Nasty nasty mean girls. And she’s crazy but quite fragile and just wanted to fit in. It was really sad to watch. And then she went all wire hangers and the wheels were off. Her friend Danny… Craziness.

    Clear-Map8121

To be fair, I don’t blame Danielle for having Danny and the Hell Angels protecting her at the time because she knew Caroline’s dirt and probably was nervous because she stepped on their toes. I says this but its true, Danielle is the tv villian but Caroline is the real villian.
