UPDATE 11/18/2013: On November 18, 2013, the federal government added two more counts to the 39-count indictment against the Giudices which was handed down on July 29, 2013. According to the indictment, the Giudices fraudulently obtained $5 million from mortgage loans, withdrawals from home equity lines of credit, and construction loans from 2001 to 2009 and failed to file tax returns for about $1 million in income from 2004 through 2008 (they are charged with mail and wire fraud, bank fraud, bankruptcy fraud and loan application fraud). According to U.S. Attorney Paul J. Fishman:

“The two additional counts stem from a $361,250 mortgage loan that Teresa Giudice obtained in July 2005. In the course of obtaining the loan, she and Giuseppe Giudice prepared a loan application which falsely stated that Teresa Giudice was employed as a realtor and that she had a monthly salary of $15,000. Teresa Giudice was not employed outside the home at the time.”

Real Housewives of New Jersey’s Teresa Giudice and Joe Giudice — who have been plagued with financial problems for years — were indicted on fraud and tax charges on Monday, July 29. In his 39-count indictment, U.S. Attorney Paul J. Fishman charged the Bravo reality stars with conspiracy to commit mail and wire fraud, bank fraud, making false statements on loan applications and bankruptcy fraud.

“Today is a most difficult day for our family. I support Joe and, as a wonderful husband and father, I know he wants only the best for our lovely daughters and me,” Teresa tells Us Weekly in a statement. “I am committed to my family and intend to maintain our lives in the best way possible, which includes continuing my career. As a result, I am hopeful that we will resolve this matter with the government as quickly as possible.”

The indictment also charges Joe with failure to file tax returns from 2004 through 2008, during which time he allegedly earned nearly $1 million.

“The indictment returned today alleges the Giudices lied to the bankruptcy court, to the IRS and to a number of banks,” Fishman said in a statement. “Everyone has an obligation to tell the truth when dealing with the courts, paying their taxes and applying for loans or mortgages. That’s reality.”

Garden State natives Teresa, 41, and Joe, 43, are parents to daughters Gia (born 2001), Gabriella (born 2004), Milania (born 2005) and Audriana (born 2009). Teresa, who has authored several cookbooks, began appearing on The Real Housewives of New Jersey when the series — now in its fifth season — premiered in 2009.

“The privilege of living well in the United States carries certain real responsibilities, including filing tax returns when required and paying the correct amount of tax,” Shantelle P. Kitchen, Special Agent in Charge, IRS-Criminal Investigation, Newark Field Office, said. “Today’s indictment alleges the Giudices did not live up to their responsibilities by failing to file tax returns, falsifying loan applications and concealing assets in their bankruptcy petition. The reality is that this type of criminal conduct will not go undetected and individuals who engage in this type of financial fraud should know they will be held accountable.”

Conspiracy to commit mail and wire fraud carries a maximum prison sentence of 20 years, while bank fraud carries a maximum of 30 years. The remaining charges could result in more prison time — not to mention the hefty fines associated with each penalty.

The Giudices are scheduled to appear before Judge Cathy Waldor at the United States District Court in Newark, New Jersey, on Tuesday, July 30. A rep for Bravo had no comment when contacted by Us.

Teresa’s attorney, Henry Klingeman, tells Us:

“Teresa will plead ‘not guilty.’ The judicial process that begins today with an indictment is a search for the truth. As it moves forward, we look forward to vindicating her.”

Joe, a former pizza parlor owner, also faces 10 years behind bars for allegedly using his brother’s ID to obtain a driver’s license in 2010; he will appear in court on Oct. 28.

“Joe maintains his innocence,” his attorney, Miles Feinstein, tells Us Weekly in its July 29 issue. “It will be tough to choose a jury because of the high-profile defendant.”

Authorities, citing the indictment, said that between September 2001 and September 2008, Giuseppe and Teresa Giudice, both of Towaco, allegedly committed mail and wire fraud conspiracy by giving lenders fraudulent mortgage and other loan applications and supporting documents in an effort to obtain mortgages and other loans.

In addition, the Giudices falsely represented on loan applications and supporting documents that they were employed and/or taking home substantial salaries when, in fact, they either were not employed or were not receiving such salaries, authorities said of the indictment’s allegations.

For example, authorities said, in September 2001, Teresa Giudice applied for a mortgage loan of $121,500 for which she submitted a loan application that falsely stated she was employed as an executive assistant. She also turned in phony W-2 Forms and fake pay-stubs purportedly issued by her employer, authorities said.

The indictment also points to specific instances of the Giudices allegedly committing bank fraud and loan application fraud in the course of securing loans from several banks, authorities said.

On Oct. 29, 2009, the Giudices filed a petition for individual Chapter 7 bankruptcy protection in U.S. Bankruptcy Court in Newark, authorities said. Then during the next few months, they filed several amendments to the bankruptcy petition.

But as part of the bankruptcy filings, the Giudices were required to disclose to the United States Trustee, among other things, assets, liabilities, income, and any anticipated increase in income, authorities said. But the indictment alleges that the Giudices intentionally concealed businesses they owned, income they received from a rental property, and Teresa Giudice’s true income from the television show “Real Housewives of New Jersey,” website sales, and personal and magazine appearances, authorities said.

In addition, the Giudices allegedly hid an anticipated increase in income they expected to get from the then-upcoming Season Two of the “Real Housewives” show.

The Giudices are charged with multiple counts of bankruptcy fraud for concealing and making false oaths and declarations about assets and income during their bankruptcy case, authorities said.

The indictment also contends that during the tax years 2004 to 2008, Giuseppe Giudice received $996,459 in income, but failed to file tax returns for those years, according to authorities.

The conspiracy to commit mail and wire fraud counts brought against the Giudices carries a maximum potential penalty of 20 years of in prison, authorities said. The bank fraud and loan application fraud counts each carry a maximum penalty of 30 years in prison and a $1 million fine, Fishman’s office added. The bankruptcy fraud counts each carry a maximum penalty of five years in prison, authorities also said. And the failure to file a tax return counts against Giuseppe Giudice each carry a maximum penalty of one year in prison, they added.

Hello Loveys!

What did you think of the Miracle at St. George? I think I haven’t cried that much in my whole life. I cried all over again watching it. All this nonsense about our family not getting along for 10 years just isn’t true. You can tell from how we were at the end of the episode — cooking and laughing and enjoying each other like close families do. I wish I could have had every one of you in the room with us to feel the love. You deserve it after watching our darkest moments! Thank you all so much for keeping the faith in my family!

I have called Melissa directly to talk about this, because like Dr. V said, I want to keep the communication lines open, but I wanted you all to know as well: I never meant to sound like I was threatening her in my last blog. I was very shocked and upset to watch the episode and see Melissa talking about my marriage and my products — two things I work really hard at and am really proud of! We don’t know what other people say about us when we’re not around until we watch the show, and it is hard, like opening up an old wound.

A few weeks ago, before the episode with the two of us meeting aired, Rosie called me to say that she was sorry for some of the things she had said, to warn me it might be ugly, and to make sure we were still good. That felt amazing, and made it so much easier to watch the episode because I know she didn’t mean it and truly cared about me. If Melissa had given me the same heads up, I’m sure I wouldn’t have been so angry in my blog. I’m human, I’m not perfect, and her comments hurt.

We did end the season in a really good place, so I was very surprised when Melissa’s first blog came out and bashed me. Even though we were watching an old place we’d been in, I wanted to keep the peace going in our blogs. Instead of retaliating or getting into a place of tit-for-tat, I called Melissa immediately. I told her I was confused and upset by her blog since we were in a better place. She told me to “get over it.” I suggested we both keep our blogs positive, but she said she was going write about how she felt at the time, and that I could do whatever I wanted. I chose to stay positive until the marriage comment. I finally broke down, and I’m sorry for that.

But me saying last week that Melissa was “lucky” I didn’t spread lies about her marriage like she did about mine, was simply that: I haven’t, wouldn’t, and won’t. It wasn’t a threat that I was going to expose something about her, and I’m sorry she took it that way. I was trying to explain my disbelief and devastation that the same person who has claimed for years I was trying to break up her marriage, when nothing about her marriage has ever come out of my mouth, actually said those horrible lies about mine. For a family member to say that is truly terrible, because it plants a seed that maybe they know something other people don’t. Melissa might have no problem doing that to me, but I wanted to explain that I would never do that to her. She is my family, and I would never want my nieces or my daughters to hear something untrue and hurtful about her marriage.

I wish she had the same courtesy for my marriage. I wish she had warned me ahead of time, apologized after the fact, or taken the time to step into my shoes and see why it might upset me. I don’t know or have ever even met or talked to any of Melissa’s ex-boyfriends or ex-bosses or whatever. I don’t know about her past, and I don’t care to. I only care about the present, and in the present, I promise I have nothing to do with hurting my family.

All right, no more heaviness! We still have a long road to go. Wait until you see me and Jacqueline finally meet next episode. The miracles aren’t over yet!

      Your dead on, dead on. They want him to do time, but I think there is more here and Joe and Teresa may know it. I think they are going to go hard on both Joe and Teresa (remember she either willingly said she was working when she wasn’t or Joe forced her to do it and either case they will make her put another nail in his coffin) in order to get them to flip on people. Listen the federal govt. isn’t dumb, they know about Chris Laurita and his family draining a major company out of 55 million dollars and using the proceeds to live a lifestyle. They know that Albert and the Brownstone has shady going ons happening their (especially if you go to the Lipstick Alley article and find out “she linked it” that many people where doing their bribery business at the Brownstone).

      They won’t give Joe 2 to 5 years, they will try to give him major time to get one or the other to flip information on the rest and anybody else he knows. And Teresa won’t get probation unless she has information to give them. You see I think everybody is thinking that she has 4 kids who will take care of them etc. etc.. Many mothers go to prison everyday for more or less of what Teresa has done. The govt. won’t care because they know that whatever defense she will use and what excuse she will say is BS and she knew it. She wanted to live a certain way (remember Danielle at the country club saying that I saw the house you used to live in before the mansion, I’m still trying to find if anybody has a pic of that house or it’s address) and turned a blind eye to what her husband was doing and even participated also. She could have stopped at anytime but the co-dependancy they will say and her 4 kids is what made her to continue along with the charade.

      You have to realize everything that they have on them have teeth, from the use of wire transfers (cross border) and the federal mail system, and their own words and documents that where false when confronted. There isn’t no hearsay, it’s fact and it has teeth, and so the reason why they got seperate attorneys (either on agreement or on her own) because she wants or needs to distance herself away from Joe and set up a defense that will destroy Joe. I was in an abusive relationship and he was telling me to do these things etc. etc.. Caroline was correct about Teresa husband going away and her having her own show, but I think that Teresa will be in for a shock

        Well, Tre obviously knew what she was doing was wrong. She created fake w2s, etc. I do like Tre and Joe, but truthfully it looks like Joe will prob end up in a low/ security prison with other tax cheats. It could be 5 years. What were they thinking? Didn’t Wesley Snipes go to jail? This is crazy stuff.

          Noone has said that Teresa created any documents only that she presented them. Huge difference! Don’t embellish or assume,only the facts as presented. Everything is not as it seems and all of this is supposition and hearsa.

        Buck – You need to understand federal law on bankruptcy/mail/mortgage fraud and the separate IRS code to glean what may or may not be presented to them in order to settle this case. Mail fraud is a basic federal charge. If you stick a stamp on a response to an IRS notification, that could be construed as mail fraud if you provide incorrect/incomplete information in that response. Mail fraud can occur between two zip codes within the same state…it’s that simple.

        They aren’t looking for “flippers”; they want the tax returns…and the related tax payments.

          Your exactly right about the Mail fraud (didn’t say anything about the wire transfers), but it’s used all the time as a catch all if the other things failed. Do you remember Tom Cruises movie The Firm. In the end he gave the FBI Mail fraud and multiple counts on each member (just like Teresa and Joe). He said it has teeth and they can’t obfuscate around it. In regards to Joe and Teresa they can’t get around it either, so they either have to give the Fed what they want or they can get time for each count of the catch all of mail fraud (and thats if they are able to get past the other stuff). And they are looking at both the money and the flipping, if they can get other people in serious crimes also so be it. But since the FBI or fed knows that Joe and Teresa is close to alot of people, why not rattle the cage and see what comes down.

          The mail and wire fraud charges stem from the mortgage and loan applications. Original documents are “mailed” to the lender and “wire” from the transfer of funding from an approved loan. The “others” indicated in the charges would typically be load originators – the folks who sumbitted the paperwork to the lender.

        Yep. Lauryn Hill is doing prison time for tax evasion with six kids at home, so why should they go any easier on Teresa?

        Don’t worry, Kaywhims, I’ve been hearing it too! I just have a feeling all of the other cast member’s are involved with “taking down the Giudice’s!”. Typing that ticked me off because of the the words “Taking” and “Down”. What couple used those words to get cast on the show? I would love for the Giudice’s to cooperate with the Feds, if given the chance too, but the reprecussion’s for snitching would be bad for them. In the underbelly of the mob world I would think that Joe Giudice has friends that will get even for the people responsible for the indictments! I’m not wishing for that type of retaliation done to families with children. It’s just that when you play dirty you get dirty! Your not going to come out clean on the other side! I don’t think I can watch the show, now, because I now see how it’ll probably end! Sure, I would love to see Tb & Tsil get kicked off the show then have to publicly ask Tre for financial help! I also, would love to see Jaq get taken away in a straight jacket yelling, “TERESA, TERESA, TERESA!!!”. Another one would be to see Richie get his butt kicked by someone’s father, brother, Uncle or husband for his treatment of women! It would be nice if Vito dumped Laureen and took up with a good lady who is secure in herself and can smile at people who do good for others! You know, I said a prayer for the Giudice’s maybe, to be a better person, I’ll pray also for the other families, too? That’s what I do when I feel like I’ve been stabbed in the back by someone, I pray for them. This is the Giudice’s real life, even though I don’t know them, I’ll pray for their enemies.

And come he’s not the sharpest tool in the shed literally he gives himself off as being remedial and he wants the viewers to think he designed and built that house….. I don’t think so! My nephew is a contractor and let me tell you the test a person has to take to be a licensed contractor is very very hard there’s no way T’s brother passed that test with the little knowledge he portrays himself to have unless he took that test like a 100 times. I would be willing to bet he and famewhore are freaking out that they’re next, we have all read here and there about his shady dealings. And Jaquline and her husband must be sh*ting in their pants too remember what those two did with the company they used to own? What kind of people take money from an organization trying to find the cure for cancer?? That’s disgusting! My point here is all of these people have skeletons in their closet not just Teresa and Joe

    This is crappy. Really crappy. I’m not surprised by their shady dealings, but at the same time, EVERYONE on this show is shady, including the Lauritas who scammed the Susan Komen charity. It’s all really crappy and I feel bad for her kids most of all. I’m sure the Gorgas are thrilled, though. Now it really can be Melissa’s show.

      I am sure they are. What they forget is if Tre goes away, the entire show and cast go away because none of them can carry the show. Bravo is about to lose out from all those lucrative deals Tre makes with her cookbooks, etc. I would like to know how the Lauritas get a pass.

Why do you think Wacky was so concerned about Teresa and/or Joe going to prison during her patiopalooza breakup scene. She wasn’t interested in Teresa’s life, just what she could learn to save her own neck.

          The entire cast worked so hard to get her to speak about her finances as well as her court case. They were trying to get her to implicate herself and Joe in the case. Knowing full well they were facing time in federal prison. Great friends and family!

      I love Teresa and her family. However, I always wondered where the big money came from. The Laurita’s, in my opinion, are caught in a much bigger trap. I certainly hope Joe and Melissa are not rejoicing too much either. Their source of their wealth is even more questionable. Bottom line, I hope Joe and Teresa sing like birds. I also have a gut feeling the Laurita’s turned them in, in the big scope of what the Fed’s have to enforce, digging up Teresa and Joe’s old loan applications seems like a waste of time and money.

      When you have to dig into old bank loan records? It appears the Fed’s were scraping the bottom of the barrel. As for not filing tax returns, that is another problem.

      However, the IRS does and continues to make mistakes. I received many letters, one within the last few months concerning MY 2010 taxes not being filed. Just me, not my husband and we have always filed jointly. I, again, took it to our tax preparer and again, she sent them a copy of our 2010 return. From what she could tell, on one of my 1099’s (which I did claim that year, as I do work part-time when needed) my name was completely butchered, because that is the Jackie that keeps getting the letter. I cannot emphasize the importance of going to a professional to have your taxes prepared, especially if there are several schedules to be completed. She assured me, if I were ever called in for a review or audit, she would be sitting right next to me to explain how my taxes were prepared. She also informed me if it was some error on her part the firm she associated with would pay any penalties involved.

        Isn ‘t there a Statute of Limitations of 10 years? I think some of these charges will be dropped because of that. The charges of Teresa lying on her mortgage loan goes back to 2001. I mean seriously, how long are you supposed to keep your financial records? A little weird too that Joe was accused of not paying taxes but not Teresa. Did she file herself without him?

          I will call my tax preparer tomorrow and ask her. I thought one only had to keep tax records for 5 years. I keep 10. Another thing to check into.

          7 years, supposedly…I work for a bank and we are only required to keep records for 7 years. This whole thing leaves a bad taste in my mouth. Part of me is wondering if they are leaning on Joe to see if he knows anything about the Laurita case. Not to downplay any wrongdoing on Juicy’s part, but the prosecution of it seems so vicious it makes me wonder if this isn’t part of trying to get the bigger fish.

            What the Lauritas did was far worse what was it something like 50 mil!
            Don’t forget this all happened when lenders were doing shady stuff to get people qualified for loans even changing numbers and a borrower’s job title to make the applicant look better. Without the applicant even knowing. Trust me people sing like birds when getting thier hair done I had a few lenders as clients back then and stuff they would tell me
            they did behind applicants backs was just plain wrong I didn’t know it was wrong then like we all do today because of all the dirty lenders being brought to light.

              It’s seven years to audit you and ten years to collect the money. I know because it happened to me. When I got extremely ill in 1999 and subsequently left my husband it left me in a mess. Very long story short, I was paying on monies I owed from the 2000 tax year. In 2010, they stopped taking the money out of my account… I had been paying monthly. I called up a tax specialist to look into it for me and they told me the garnish was lifted as there’s a ten year statue of limitations on the order the IRS had on me. Can’t tell you how shocked I was! Had never heard of that before… I thought they followed you until you died. I don’t know if it’s like that in every case. Mine wasn’t considered tax evasion or criminal in any way. I’m certainly not an expert… just going by my experience.

          When I was 18 or 19 I couldn’t find state tax forms anywhere. I never got any in the mail. I went to the post office, asked people at work if they had extra, couldn’t get one. I didn’t know enough to find a tax office somewhere, so I figured out the taxes, and the state owed me maybe 85 dollars something like that. So I was young and never did this before and figured, I don’t owe, so maybe it’s okay. Well 10 years later, they got me and said I didn’t file that year and they charged me interest for each year and said I was in potential big trouble. Well I had the my work forms still, and I filed, with a letter that said, the state owed me, and I should charge interest each year from them. LOL. Nope they weren’t giving me anything. But I sent the forms in anyway and all was fine, even though they owed me, I got nothing.

            State tax is different than the IRS. Even so, I’m not sure if they legally could have done anything… but it doesn’t mean they wouldn’t try.

        The quickest way to get this solved (I had an issue with an erroneous 1099 which tripled my earnings) is to call the IRS Tax Advocate. These are the people that attorney’s use to get records fixed. It’s a FREE service and they are great. The one assigned to me got the mess cleaned up in about a week. The attorney I almost hired told me that it would be a minimum of 5k and could take up to 6 mo’s.

    I’m sad. Us Tre fans were about to have a few minutes of vindication… I guess we don’t get that anymore. We were on the rise and now it’s done with. This makes the rest of the cast even more despicable in my eyes. They were trying to out her all season by discussing whether she was getting paid for her magazine covers, stories, etc. and Teresa kept denying it. They didn’t just want to see her go down, they wanted to see her go to jail. That is some serious hatred.

      That’s the way I see it, too, GonadGobbler! Jaq was especially going above the call of duty to make Tre tell her what’s going on with her bankruptcy while the camera’s were rolling! In a way I’m wondering if that is why Jaq, Tsil, Tb, Richie continue to call Tre a liar? Are they trying to set her up to make her look untrustworthy to help out the government? IDK, but it was strange how the lipstickalley blog came out about their mob ties! Someone knew what was going down. I wouldn’t be surprised if it was Tsil, Tb helping the Laurita’s/Manzo’s get the goods on Tre! This is just really, really sad that her family is going through this. Poor Gia, Gabriella, Malania and Audriana! Right now is when Tre and Juicy need our prayers! These indictments are serious- serious for Tre and her family! I just have a strong feeling that Tsil and Tb played a part in helping out the Government! Look at Tsil’s idiotic blogs! She’s been caught red handed lying, yet she plays innocent and blames Tre! Could that be her subconscience guilt? IDK? Tsil has seems to have no conscience, though! Gosh, I looked on People.com, Usmagazine, abcnews.com and they have Tre and Juicy right up there with the big news!

        I made this comment on another blog, but look at all the news media picking up this story, and when it comes to the Lauritas and their corporate bankruptcy, the Housewives bloggers picked up that story and reported on it, not any major news outlets. Maybe it is because Teresa is more popular, but it still doesn’t make it right that the Lauritas did worse, and it isn’t and wasn’t covered like this is being covered.

          I thought the Laurita’s were worse criminals, stealing money and putting it in their own illegal ways, however, what the indictment shows sadly, is just as bad. The Laurita’s stole from one company and paid themselves through another company, but the Guidices, stole from the government. It’s about the same. If what they are accuse of is correct, how stupid is Joe Guidice? Having Teresa use fake forms to get a loan, not paying your taxes for all those years, on and on it went. They will always get you. That’s pretty dumb. It’s one thing for them to owe tons of money on loans that went sour on his businesses, and stores Teresa’s ran up credit thinking they had the money; and then she’s paying that back now, that’s also dumb on their part to spend crazy when his businesses were going down. However, they filed and she’s paying that back. BUT, this other stuff, the taxes, false documents, etc. etc. is way worse. Plain stupidity. I don’t want to see them go to jail, and they may. Although other businesses have done this and non one went to jail. But some do. Look at Martha Stewart. It may happen. I like Teresa, but if they did all this, they have to pay the piper.

          I wouldn’t trust Jac as far as I could throw her and I hope Tre hasn’t confided on her. I believe Jac would throw Tre under the bus if it could get herself put of their own law suit . Bravo’s problem is what to do about the upcoming reunion. I doubt Teresa or Joe will show especially if Tre’s contract is up. Tre might send a thanks to the fans message but why should she have to put up with reunion sh*t with everything else going on?

        I totally agree that the Laurita’s, TSIL and TB are probably the ones who turned them in, it may be possible that the Laurita’s and TB and TSIL offered them up as a way to get out of their own mess. They may have rolled over on them to lessen their own troubles. I always thought it was strange how every chance they got they tried to get her to admit things on camera and consistantly accusing her of her getting paid under the table on camera as well, I think they wanted it documented so it could be used against her later. What’s really sad is that none of them thought about the children in all this, but maybe then again they did, maybe TSIL and TB think they will be able to ride in on their white horse and raise the girls and be everyone’s hero.

        I have no doubt they are all dirty to some degree or another so for one to point the finger at any one else is just plain wrong, but some will go to great lengths to save their own skin.

        It all makes me sick.

      I would not be AT all surprised if Bravo and the rest of the cast helped this case behind the scenes. More resolve for Teresa to have been so suspicious of them, she specifically asked them-out of respect for her kids- to NOT talk about her legal stuff on camera and each and every last one of them did and Bravo made sure it aired. I hope the truth comes out in court( I am sure Teresa’s paranoia is on overdrive)! If I were them, I would pack up and move to Italy(after court proceedings of course…) so saddened by this news

        Speaking of Bravo making sure it got aired did any one read in Whacko’s blog the apology to Teresa and TB for the nasty comment she made about them, I believe she said “That wasn’t meant for us all to hear, it was a private joke for her and Chris, they say things like that in privacy of their home all the time”, I guess she isn’t getting the good edit she’s been getting any longer either. I think that Cat knew what to edit out not only by how bad it would make them look but when they whispered something nasty under their breath she knew they wanted it taken out….

The Lauritas were corrupt, the Gorgas malicious and Manzo well, I think there is a level of Mob- business behind his actions. The Guidices are essentially ripping off “the man”. Doesn’t excuse it, it’s still illegal. But again, I would argue that this wouldn’t be front page had TSIL not bought to light the original bankruptcy to Danielle. Hey Missy, have you paid the window man yet?

      Sackem, I totally agree, especially when the Giudices withdrew their bankruptcy filing, and agreed to pay off the creditors. I wonder where all that stands, because some of the charges go back to “lying” at bankruptcy hearings, but they withdrew their petition. We know a couple that told their lawyer all the details when they filed bankruptcy and the lawyer filed the petition and it was granted. However, the lawyer kept putting the wrong address on something (entirely their mistake), it opened up some legal issues a few years after the bankruptcy was discharged, and our friends became entangled legally because they said that they did not update the court and because the lawyers kept trying to get it straight about the address, that the file was still open and our friends were required to inform the court of changes. It became a big legal mess for our friends, who informed the attorney of every little detail and it was clerical error on his part, but the court didn’t care because for one all attorneys consulted and involved agreed that a Trustee gets assigned and can rack up quite large legal fees because he opened an investigation. Meantime, he isn’t really doing much because the defendants’ lawyer and the lawyers for the creditors are doing all the negotiations. They all agreed thought that this is how the system works and the Trustee, who is an attorney, can make a very large fee. Since this bankruptcy was withdrawn, but they decided to investigate anyways, the Trustee wanted to keep this open to rack up legal fees for himself, and there is no negotiation there–if he says you owe a Trustee’s fee of $100,000, then you have to pay that–no proof of time spent on the case–no negotiating a lower fee, etc., and your file cannot be completed or closed until the Trustee collects that fee, so you have no choice but to pay the amount that they charge. I am sure since their petition was withdrawn, the only way the Trustee continued to collect was to open an investigation because with the withdrawal, his services were no longer needed.

      Several lawyers told our friends that filing a bankruptcy is a big business as far as attorneys that get assigned as Trustees, because this is a “freebie” for them, as far as the fee. It is other attorneys or accountants, etc. that do most of the work than the Trustee actually does, but he collects that fee and there is nothing anyone can do about it. I am not condoning any wrongdoing on anyone’s part, but since they withdrew their petition, I would like to know if these mortgage holders have been paid, and if they have been, then it is about the government making the money now and the lawyers and staff that are the Trustee in this case. I am reserving judgment on all the charges, and again I don’t condone it, but so many corporations get away with so much, and mortgage brokers who encouraged people taking loans that became the “mortgage crisis”, and there were no real repercussions for them. We know many self-employed people, and a mortgage broker would approach them and encourage them to give a statement of income, essentially just saying you made so much money, without having to prove it, because they wanted the loan. I have a feeling that some of that went on here, since they say Joe was self-employed. The non filing of tax returns is another matter, but again I am curious because they only claim that Joe didn’t file, but this is not one of the charges against Teresa.

      If the cast and their on camera rants about the Giudices’ legal and financial problems played a part in this, then I hope karma comes back to bite them. Jacqueline especially kept bringing it up, and saying that Teresa had a plan to go back and screw the creditors out of $11,000,000, when they were at Melissa’s launch party (when Melissa and Teresa discussed TSIL contacting Danielle). At any rate, I am going to reserve judgment, pray for them (they have 4 young children), and wish them the best of luck. Teresa and Joe both showed how mature and truly loving they were in yesterday’s episode. Joe in particular, showed such class about forgiving and letting go of things, no matter how bad family and friends tried to hurt them. I was really impressed with Joe regarding the Lauritas and his talk with Teresa, who was extremely anxious about talking to Jacqueline (personally I would have given her the opposite advice). I admired his maturity and feelings regarding letting go of the past. I realize that he has probably made some financial mistakes, but he has been showing us that he is respectful and more forgiving and classy than these other idiots on the show. Whatever his mistakes, I won’t take away what we have seen from him this season with Teresa, his children, his elders and even the rest of the cast. He has shown more respect than all the others put together, and that he truly says he is over it, and is really capable of putting it behind him and move on and give them all another chance. I wish him and Teresa much luck with this latest news.

        Bankruptcies create thousands of billable hours for attorneys. Every couple of months or so most firms will submit fees to the court for hours and fees expended to date during the duration. Between partners, associates and paras, the fees add up quickly.

The comment from Joe during the sit down with Dr. V, “Im the only normal one here.” That made me giggle (and prob is so very true) bc he’s so real too.
        This sad news is so disappointing:( I feel they are truly good people with tremendous hearts. I will still support their family, and pray for the best possible outcome for those beautiful girls.
        Melissa saying such horrible things about Juicy and Tre’s marriage was so hypocritical and just low down and dirty! And then hoping he goes to jail. Yeah she’s such a great aunt to wish her nieces father goes to jail. She’s everything she ever said Teresa was! Teresa’s right, Melissa should of warned her about the nasty things she said. Oh, but wait, she wanted to hurt Teresa to stir up some anger!

    Look we all knew that they were all scheisty. Every last one of them. We all picked the lesser of the evils. This coming out comes as no surprise which says a lot about the quality of character there is in reality tv. It’s an enjoyable watch. It gets us hooked and talking and meeting others of like mind online. We connect w/ them not because we want to hang out with them or because we truly believe in their cause but because they sometimes embody something we are empathetic with. But if they shut down the series tomorrow, our lives would be none the worse.

    I will not defend them for doing stuff that is blatantly wrong. Its just as ridiculous as the alternatives of ‘I told you so’s’ and anti Giudice vibes. At the end of it all it is purely entertainment.

    If anyone was caught by surprise by any of this then you all haven’t been reading the blogs long enough.

    The show goes on, and Bravo will continue to struggle with scripting “interesting” storylines because they can’t go with the truth.

          Iris, I believe you are correct about the Manzo’s. I always felt that it was odd that Caroline was gloating during the reunion (Season 3?). She stated that “The truth will come out,” with such certainty and everyone thought she was referring to Juicy cheating. Personally, I believe she was referring to exactly what has now been brought to light: these charges against Tre & Juicy. Caroline KNEW how it would eventually play out.

Andy knows Jaquline can’t be trusted to keep something to herself after what she pulled during season 3 reunion and went crazy on Twitter leaking storylines and stuff while season 4 was still being filmed that’s we all read right? Maybe all these goons got together except for Jaquline and decided to turn the Guidices in remember they all well aware that Teresa has dirt on all of them that they can’t afford to be spilled they kept Jaquline in the dark because we all know she would of spilled the beans during one her drunken binges on twitter. I’m just saying my opinion that all this seams so suspicious com’mon the Lauritas did far worse with that signature apparel, then Chicklet teeth and the whole Exxon thing, Joey and Melissa did something with that spec house they’re living in and all those people coming forward demanding SloJoe pay them for the work they did for him on thier house? We all know about Gorga’s audition tape… but could Bravo have a hand in the prosecution’s case that has obviously been building for several years ? Has Andy already testified ?
          We all know Andy does not like the Guidices. Andy’s body language on WWHL Sunday was telling. He leaned as far to the right side of his chair as possible, opposite of Teresa and Dr. V.

            The damage had already been done by that point. The Guidices were already caught up in their lies and the fraud and many say it’s the reason they withdrew the bankruptcy… hoping they wouldn’t be charged with fraud in doing so. Teresa pretty much kept her mouth shut and would say she couldn’t talk about it when Andy asked her questions. We know that she wasn’t talking to Jax about it, even thought Jax was pressuring her (that seems all the more despicable now). There really wasn’t anything said that would have made the situation worse than it already was.

            Obviously the Guidices were foolish for doing what they did. They exacerbated it by flaunting their lifestyle on the first season of RHoNJ. Filing the bankruptcy was their biggest mistake (other than the actions for which they’re being charged). It brought everything to the forefront.

            Eventually the IRS would have caught up with Joe. Maybe he would have taken care of it before the situation got out of hand, but, again, the bankruptcy was like a neon sign on their misdeeds.

      i had several years of my income tax ganked bc of my ex ( filed as married, never do that shit again!) he worked construction/ paid cash under the table, only to find out about a 1099..and whats bad is his boss didnt send one for 2 years then one year bam got 3 of them = one for current year at the time and then the two prior ones..lesson painfully learned

        Yep, worse financial mistake I have ever made was joint filing. My ex begged me to put a few loans in my name, and I declined, since he got a DUI, a wreck, and left unpaid, thus devoid life insurance payments while I gave up my career to follow his, with three babies around the country, and I was a 1099! Hence, I filed for divorce, and still had to may off his bad loans, etc. banks and credit agencies have more power than divorce decrees, and Courts in the US. IRS isn’t even a government agency!!!!!

    Folks are surprised in the sense that we’ve been seeing Teresa working her butt off for several years now, since the bankruptcy and financial issues first came to light. None of this stuff was particularly hidden from us on the show. Teresa of all people has been as open as she could be about it – there were many scenes of them in the attorney’s office discussing various aspects of the bankruptcy.

    It’s certainly possible that the reason tax returns weren’t filed for so long was because Joe’s business partner never took care of it, or a third party. I highly doubt Joe would be sitting down with a copy of TaxAct and doing it himself. When you run a business, you outsource that.

    In any case, if they’re guilty of it, then they need to pay the price, no matter how much we may like them (or dislike them the least). This is sad on many levels tho because we’ve been rooting for Teresa to pay everyone back and pull her family out of the mess…

          I always thought that patio scene smelled fishy as well, like you say – it certainly makes sense with this indictment now…I thought briefly that even Bravo might have been behind this, because the Gorga storyline was now done but what a GREAT storyline for Season 6. The only hitch in that theory is tho – what if Teresa herself goes to jail? No Teresa for the show.

          I can’t really speak to the mortgage fraud, because I worked in that industry during that time, and let me tell you, when the loan officers are filling in the numbers and telling you to do it a certain way, you should be able to trust that someone who has a fiduciary duty to you is giving you sound financial advice. This is why stated income loans became known as liar’s loans after just a couple of years. And construction was booming during this time as well because construction loans were being handed out like hotcakes, which led to a lot of speculation investing, which helped to ruin the construction loan side of things and burst some housing markets in various parts of the country.

          Since mortgages are just bonds and notes that are bundled up and sold to overseas investors, guess who was making the demands for those types of notes? Overseas investors. As a result, banks and lenders were paying insane commissions to loan officers and brokers to sell certain types of loans – namely, ARMS, stated loans, and construction loans. I mean, think commissions like $10K. The amount of points you paid on a loan were directly correlated and chosen by the loan officer depending on how much money they wanted to make on the deal. So there was a huge incentive for a loan officer to push you into a stated loan because those paid the most (along with ARMS), and since interest rates were so low at the time, it was easy to push people into getting a loan they couldn’t afford because it was presented as a loan that they COULD afford. Enter interest-only loans and those types of rackets. It make it incredibly easy to start construction businesses and in fact several loan officers I worked with did just that.

          Anyway – not to create a dissertation on mortgage banking – but I’m not selling the Giudice’s down the river over a loan application. It’s what millions of people were being told to do by those in positions of fiduciary responsibility…I can’t even sell out the Gorgas for doing it. Nobody in this country could have done it without the banks making you feel like an idiot for not doing it. It’s why so many banks and lenders started imploding 6-7 years ago. If anything the fraud started at the top.

          Mail fraud, as others have mentioned, seems like a complicated offense that’s only too easy to unwittingly be guilty of. Hell, putting a flyer in my neighbor’s mailbox is fraud. Opening their mail is fraud. For all we know, 39 counts could mean 39 envelopes with wrong addresses.

            You are so right about interpretation as stated in your last paragraph about mail fraud. Many people do not realize things they (innocently) do every day could be considered “fraud.” What p*sses me off to no end is that so many large corporations get away with SO MUCH tax evasion with loopholes their hired professionals find for them, but the IRS goes after the little guy with a grip like a rabid pit bull, jaws clamped and shaking every last penny out of them. It disgusts me.

            What is sickening is that, in the big picture, the relationship between our government and large companies is “you scratch my back, we’ll scratch yours,” and accommodations are made every day because they can do things for each other. Where our government could really be making the big tax dollars, they fall short. Yet they’ll spend millions to employ people to go after the little guy and small-medium sized companies who are barely making a profit, let alone have the funds to hire tax professionals (a must). Wonder what they’re going to do with all the tens of thousands of people who live in (bankrupt) Detroit who stopped paying any kind of taxes years ago? You got it. Nothing. Talk about a screwed up system.

            I wish Tre and her family the best in settling these charges against them once and for all. I wish the other cast members what is due them (karma) … their day is coming and soon.

But what troubles me is recalling the 2 previous seasons of her “family”/ “friends” and even her own boss trying to get her to discuss and publicly implicate herself and/or her husband for her monetary legal issues–meanwhile the entire rest of the cast has (at least at one point and some very recent) the same legal issues!!! That’s what upsets me-it appears as if the rest of the cast and production may have had some inside information about this…in retrospect, it almost seems like there were 3 major things going on the past 2 seasons–
      1)her family/friends dehumanized her( bitch, scum, garbage, ugly, monster, liar…)
      2)her family/friends made grand (and mainly nonsensical) attempts to distance themselves from her
      3)her family/friends have projected MOST of their issues on to her

      to me, these are all actions of GUILTY people!! Think about how Joe Gorga acts…I think he felt so guilty and THAT’S what all of that “say you are wrong” crap is about…to ease his guilt for HIS actions! Idk, thoughts? I am interested in what ppl are thinking…

      It crossed my mind. Joe Guidice and Chris Laurita were good friends (as was noted last night). Perhaps they talked about things. Perhaps Chris Laurita shared some of Joe’s things with Jac. And Jac is clearly unstable.

      The fault clearly lies with the Guidices. Dance to the music, you gotta pay the piper. But it wouldn’t surprise me if some information was “given” to the Feds from some “sources”.

          the Laurita case is the bigger fish in this case, millions were involved. Assuming Juicy didn’t pay taxes on the less than 1 million he made over 4 years, that’s still less than 500k the government is out. Something doesn’t add up here.

I am clueless about this kind of investigative process, would Tre and Juicy have known that this might have been coming? Does anyone think it’s possible that the feds are actually going to try to get info on the Lauritas from the Giudices and will offer Tre and Juicy a deal in exchange? This is just heart wrenching on so many levels. My prayers go out for their girls and for them, as well.

          Yes, the Laurita’s have a 55 MILLION $$ judgment against them and have been (Jac) projecting their issues on to the Giudice’s for 2 seasons now. I think the gain is, they said they could hand them a high profile case for leniency…and that is what sparked Jac’s ( otherwise nonsensical) mission to get Teresa to admit to being paid for things under the table and behind the scenes.

          If I had a legal judgment against me and my family, I wouldn’t be sitting pretty and I wouldn’t be so cocky about things and I certainly would not be publicly passing judgment on my best friend who is going through a similar but less circumstance…unless I knew things about it that my friend did not know…

          I also think her brother squawked to the feds and that is why he has been on the mission to get her to publicly admit to wrong doing…it would(in his mind) then absolve HIM of being wrong for turning on her…if SHE herself admits she is wrong…

          These are all classic defense mechanisms and communication tactics that we are witnessing, and without the context of the issues, the average person is going to take them at face value (ex. Joe is upset and crying so Teresa MUST have dome something…)actually, there are scores of studies that explain what is actually going on in terms of communication and human relations.

          I have to go with logic and I think that the truth always has a funny way of revealing itself . I realize that they are all bound by contract which is serving to suppress the full truth, but my guess is that the court might override Bravo’s contracts if these cast mates have implicated the Giudice’s on record, that will come out.

          Nobody can escape karma!

        I have to wonder if the Lauritas in going before the bankruptcy court and all the allegations against them, decided to “drop a dime” on anyone (Giudices), in order to help themselves. I can’t imagine that, because what they have down is much worse, embezzling the money from their companies and not paying the creditors (Giudices withdrew their petition and it was about loan apps more than screwing so many creditors). However, Whacko is so unstable, and Caroline’s comment that “her husband would destroy Joe Giudice”. The Lauritas/Manzos have no credibility with me, because of their behavior last season and turning on Joe and Teresa for no real apparent reason. All their comments about financial and legal problems, and continuing to live the same lifestyle, and the one who surprised me the most was Chris Laurita. He made quite a few very nasty and revealing comments, last season, regarding their legal troubles. I do not trust them at all after last season, and it seemed to come out of nowhere from the previous season. However, I do think the Lauritas would be the “bigger fish” where the IRS is concerned. It is a mystery to me though, that we hear so little about the Lauritas and their devious dealings, and then so many headlines regarding the Giudices and a withdrawn petition. Let’s see what will be said after tomorrow’s court hearing–I am sure all of this has to be overwhelming, and God bless Teresa, you wouldn’t know it (on WWHL last night and her same bubbly self). She is truly a strong woman.

          Isolde: I believe you’ve got it. Legal maneuverings are beyond what we know and what has been publicly stated. When it comes down to it, nailing the Lauritas and/or Manzos is much bigger for the feds than nailing the Giudices. Doesn’t this give the feds leverage against the Giudices and the possibility of using this leverage to get more facts on the bigger fish?

          Consider all the information given out (published) about Tre and Juicy’s problems to what the public knows about Lauritas and Manzos (because Tre doesn’t yack about what she knows to every social media outlet or magazine). Could there potentially be a plea deal in the works here in exchange for information and/or testimony?

    Teresa’s brother has turned on her. Her friends betrayed her. I knew what’s been going on with them. It’s been discussed on the show, in magazines and through nasty comments. I also have read about the Manzo’s, Wakilies and Laurita’s finacial.problems. I AM STILL supporting Teresa because I am not going to be another person who turns on her when the chips are down.

        I always try to do the right thing. I have never made a mistake this big but I have made mistakes in my life. It would kill her father if she went to jail. Her girls need her. I think she’s a good mother. A wonderful daughter. I don’t know anything about cases like this. But I hope she pays what she owes and learns from her mistakes. Money isn’t everything…your family is.     I really don’t think it matters how the charges came about if it is true then they broke the law. While I realize that might not be a popular statement it is how I feel.

    Again I feel so sorry for the girls and I hope that everything works out for everyone and the girls get to at least have one parent not in jail. Sounds to me like someone is going to jail over this.

    So sad but I still love the Guidices just not happy with the choices they made.

      I feel that way too, Debbie! But I have to say I am also disappointed – I know “innocent until proven guilty” but for me, after reading that indictment, there seems to be an awful lot pointing in the direction that more than likely there is some guilt involved.

      I am most concerned about those girls – and that is something both Teresa and Joe should have been from the day Gia was born. For me, that is a tipping point. There’s no excuse for parents to put their children in jeopardy the way Teresa and Joe have, and whether they are guilty or not, they did do something to bring about this indictment and it now has caused a terrible stress on their children.

      The possibility of those girls losing both their parents to prison rested on their parents’ shoulders. I feel bad for Teresa and Joe but I feel worse for the girls. And needless to say, I am not happy with their choices either. 😦

The only questionably ones-to me- are Rosie and Kathy in terms of actual involvement. I think Rich either did squeal or has really pushed for Kathy to and she has had second thoughts or had general regrets and that is why Rich always points out all bad things about Teresa, to say “see Kathy, she is evil, we were right for doing what we did!”

    This is a very complicated topic to discuss in an open forum and I caution all of you to be judicious in what you divulge about your personal issues with the IRS in your comments. As a former CPA who performed decades of tax prep work, I can tell you that the failure to file is a serious matter and should not necessarily be blamed on whistle-blowing by other parties…mainly because the IRS KNOWS, through various other source documents submitted on an annual basis (W2, 1099, 1098, to name a few) whether or not a tax return has/has not been filed. Sorry, don’t mean to be so heavy!

      I understand what you are saying. I am merely speaking of my own personal experience, as all of my/husband’s income was reported and I have nothing to be afraid of the IRS for.

      I worked with the 17th JDC for over 33 years, then worked for the Department of State. I just find it extremely odd that someone would take the time and use tax payer’s money (people do not work for free) to go through old loan applications, without being “tipped off”. In real life legal 101, that stuff just does not just happen.

        moma – in real life it does happen. If you remember, Teresa withdrew her bankruptcy in order to avoid fraud charges. The amount of money the Giudices were in debt was $11 milion. That is a huge amount of money and I am sure that did not go unnoticed by the IRS. The IRS wants their cut and they probably want to know where all that money went. It is not unusual to dig back to loan applications, especially in this case given the times back in 2001-2006 when banks were giving out money like candy to people who didn’t qualify.

        i’ve never worked for the gov. but my experience is that people especially working in the gov. have way to much work to do already. all the paper work just to get my daughter in school is ridiculous. to go back to 2001-2006, they knew what they were looking for. they only come after you this hard if they know something, and where to look. i called my family and told him about known drug house, i didn’t have proof so they are still there. i’m not a snitch but this time kids was involved, they had kids over there skipping school. well anyway they had to have something to look for or my brother in law lied to me.

      Thank you for your comment. I love me some teresa, but the Guidices shouldn’t get a free pass if they broke the law. Others cannot blame others for their wrongdoings. Besides Teresa was not forth coming with any info to Jacqueline about her troubles with the law. If Jacqueline, Caroline or Melissa knew a fragment about this, I think it would have been out a long time ago. Jackhole would have sunk her teeth in that bit of info and blabbed it to the world on twitter.
      This bit of news makes me sad 😦 I like to think these charges are just staged for the public eye and the guidices smartened up and sold out the lauritas and manzos…. and down the road the charges against the guidices will be dropped. I doubt it tho =|

      Yes, you’re correct. We need “the taxman” song about now. Sucks when she was working her ass off, for the bankruptcy while dealing with personal matters, and in tv. Wasnt there a big deal over past couple of weeks that T collects cash at her signings? I think this was all leaked, still.

    On every housewife franchise there are those with legal issues; every member of the Manzo and Laurita’s have been through this or are going through this and the Giudice’s are no exception. Bravo will protect their investment and see that she doesn’t go under but I am sure Joe will take the fall for it. He doesn’t seem to mind being the proverbial bad guy when it comes to their legal stuff. I hope they get through this, couldn’t have come at a worse time for her but Tre will be stronger for it.

      Whacko should be careful how she handles this… this could be her in the not too distant future. They should all keep this in mind. Even when whispering about it.

          That is true moma – more than likely this case will not be resolved for a few years. Look how long the Discovery took – this all probably started back when the Giudices filed bankruptcy in 2010.

    I feel awful for their girls. But if Juicy and Tre did some shady business and got caught, they need to pay for it. I kind of wonder if their bankruptcy brought all of this to light. Maybe, just maybe, if Tre can prove that she’s been working to pay off her debt, they may go easy on her. And hopefully they will take in to consideration that they have 4 children at home to take care of. I think Juicy would be the kind of guy to get a deal worked out where Tre would get immunity, and he would go to prison. What I can’t understand is this- most business owners have an accountant or someone do their taxes for them because the taxes are a little more complicated. This isn’t a job for Turbo Tax! I find it hard to believe that Juicy and Tre didn’t have an accountant or an attorney to keep on them about filing their paperwork.

    The Lauritas, Manzos, Wakilies and Gorgas would all do well to keep their mouths shut on Twitter, and in interviews. They all have skeletons in their closets that are trying to bust out.

      I would think they had an accountant, but the IRS does not fail to send you notices on taxes not paid nine years ago. Juicy and T would be aware that these were issues that needed to be taken care of, and frankly if I were them, even if I did not owe as much, I would have paid what the IRS is asking for and tried to get it back later.

    I do not believe anyone “turned” the Giudices in. The investigation and the fact Discovery began as soon as their personal bankruptcy was filed. The government knows that most people will try to hide assets when filing a personal bankruptcy. While digging, the lack of filing income tax returns was more than likely uncovered. The government doesn’t really care where or how someone earns their money. They just want to make sure they get their cut and they don’t look kindly on anyone not paying their taxes. That is when it probably became open season and the digging began in earnest going all the way back to 2001.

    While the Giudices will be indicted on 39 counts, the Fact Discovery is ongoing and if anything else is found, there could be additional charges.

    Don’t forget that the IRS is under intense scrutiny these days for recent audit practices and the abuse of government power and its frivolous use of agency funding, etc, and, unless the law is repealed, the IRS will govern and “police” the new US healthcare policy.         I for one disagree we are the only civilized country to not have health care. I will never understand the selfish people who would much rather have people die, when you could pay possibly 5 dollar more each paycheck and tax season and have a human life live.     WOW What a sad day this seems for all of us here, twitter world is a little quite too. I got up this morn made coffee and sat down to get my hit of FAME and honestly it felt like reading death notices in local paper of someone I knew, turned it off but couldn’t stop thinking about it so 4 hours later decided to ask questions.

    I don’t know anything about USA tax etc but did T & J know last week that this would be going to happen, here in oz if we owe our tax man he soon lets us know.

    After reading Heathers tweets from last week everything was GREAT and now Ts world seems to be crumbling under her, I read it may take up to 3 years for this to be resolved, but the damage is already done.

    Can T&J go to media and give interviews now, to protect her products etc and more importantly her children as they are pleading Not Guilty.

    I know this is rambling, I just can’t get the words out that’s in my head, I know I need to give up on RHNJ this is not NORMAL

      The best thing for Tre and Joe to do at this point is refer ALL questions to their legal counsel. Tre can continue and should continue with business as normal per press statement. This most likely will be a lengthy process and I just hope her castmates and Bravo respect her during this painful period and make this a taboo subject. I keep saying this … but innocent until proven guilty.

          As far as Tre’s products, time will tell how well she’s able to market her name. Since her future on the HWs could be limited and her products are somewhat linked to her character on that show, no one can predict their future marketability. Best case scenario for Tre would be to get a spin-off show or radio show like Martha now has on Sirius (it’s quite good really).

      Juicy and T should not make any statements about this to the media. It is no one’s business but theirs. And, you do not mess with the IRS. If they do not understand 100% what is happening or do not understand the questions they are asked, they could do irreparable damage to their court cases and their reputations.     I wonder if the Lauritas didn’t sing a song to the feds to reduce their own fed charges. Yesterday Chris laurita had a bothersom comment on his twitter about how he hated how people thought he had been wrong and he was going to PROVE them wrong….in fact, looking forward to it. I noticed the minute this sad news broke today-he immediately deleted that tweet – hmmmmm…..was he afraid he would look suspect??? I think so. Jaco is no stranger to contacting the IRS to snitch on others, hell – she reported FALSE info on Dina’s charity and caused Dina much stress and anguish over NOTHING! The charity and Dina wete cleared. The Lauritas have continued to spend and live high on the hog, smugly, without any visible worries since their very serious charges erupted – hmmm – could it be that they’ve known for months that this was gonna happen and they made a deal with the devil – do they secretly know they avoided some prison time because they sqealed like the PIGS that they are? Is that why they have been on film lately alluding to Chris “missing” Joe Gudice’s friendship? Smoke and mirrors, I call a big FOUL and something points them in the big direction of this tragedy – we shall see, when their indictments are served, how LESS SERIOUS their charges may have become…….

But most likely jeannie is correct, however, and the bankruptcy started the ball rolling. I feel terrible… Just when we were all enjoying juicy and tre’s redemption… Being shown in a much better light… This comes out. All we can do is pray for them at this point..       Pinky: As to Chris and Jax still living “high on the hog…” I find it strange that they can still do this after Chris stated during an episode last season that he’d sunk his last dime into the BLK water venture and if it wasn’t successful he’d be busted (was that pure bs?). Plus, they had such expenses involving Nicholas’ dx, were still supporting Ashlee, paying mortgage on that monster house, etc. Chris doesn’t appear to have any type of job besides what Bravo is paying him and Jax (Jax has her “Parenting” articles on autism, too, I guess). Their money’s coming from somewhere. They must’ve been good savers.

    Just about every housewife blog spent too much time on the Guidice’s Filing Chapter 7 situation when it first broke. It was also noted at that time that after the State filed their charges, then the Fed would file their and that the IRS would be in line to collect what was due to them! The wheels of justice be it quickly or not – keep turning for everyone. The Guidice’s are innocent until they are proven guilty. Teresa has proven that when the going gets rough then the tough get going – she parleyed her role on a cable network show into a branded, successful business and she can continue to do so. Juicy will always have her back and the love they have for their darling daughters won’t change. This is the time to be thankful that Joe and Teresa truly are old school because family will always be there for their family. They are in my thoughts and prayers.

      I recall something like that too that Kung Fu said too about the big legal issue, but I think it was referring to the bigger fish in this small pond: Manzo residency in Hoboken to run for some kind of govt office and challenge Gov. Christie, who appears to hold Manzo in contempt, …the shady BLK/Laurita investment//and the Manzo boyz new restaurant in Hoboken… Gosh, there was so much put out there over the weekend. Creepy for sure.

      No wonder Danielle took bodyguards. Sheesh. Seemed paranoid back then but now I understand her paranoia. If she knew something and even if she never said a word, the FEAR of someone thinking she ratted out anyone would be enough to explain why she was so nuts.
      What I haven’t seen anyone say yet is how the govt. will pile on tons and tons of extra charges, to make a few stick so they get plenty of leverage to deal. The problem for all of them is they can’t just go on witness protection to get out from under what’s coming.

    Haven’t the Guidice’s been making restitution for the past four or so years? I thought Juicy sold off most of his holdings in an attempt to pay back their debts. Does that come into account? If they pay back all their debt do they still have to go to trial? Does this mean they haven’t tried to pay back their creditors? Sorry for the questions I’m clueless to all this legal tax talk.

    Check out two of the financial institutions named in this case against the Giudices:
    (1) Park Avenue Bank…a former president of the Park Avenue Bank in Manhattan was charged on Monday with fraud, embezzlement and bribery in what the authorities called the first criminal case of trying to defraud the federal government’s bank bailout program (the bank was closed by the State of NY on 3/12/10).

    (2) Wachovia… in 2008, Wells Fargo & Company acquired Wachovia Corporation to create North America’s most extensive distribution system for financial services.

    Ok, let’s use common sense and simple math. They lied about their income to get fraudulent loans on properties; they parlayed those home values (overinflated) into cash outs and loans for other properties til they raked up $11 million, all the while leading a ridiculously over-the-top and tacky lifestyle. All of that came crashing down in 2009. And despite the Giudices fake attempts at paying their creditors back, there is not enough fabellini drinkers in the world to make that possible, esp as they continue to live way above their means. As members of the tax paying public we should be appalled at this shameless behavior. Did other people get to keep their homes (in this case mansion) and spend the way they do all while owing north of $11 mil?

      How many of those loan officers/banks were also making money off those loans and gave the Giudices bad advice or accommodations? Was it their fault that home values NATIONALLY were overinflated? You MUST know them personally to allege they’re making “fake attempts at paying their creditors back,” right? What, are you a neighbor of theirs?

      “Common sense” knowledge was in no way apparent during those years when the banks were loaning handfuls of money to every Tom, Dick and Harry who applied. The Fed Govt. even acknowledges that. You are confused.

      You’re right about one thing, though. I am appalled. Appalled and disgusted that many large CORPORATIONS were let off the hook for their role in collapse of our economy and the banks’ collapse.

    Didn’t Guidice try to get a … what is that called, the mortgage program that helped bail folks out who were underwater and cuz their home was over the limits for the program they couldn’t do it? Or was that Joey and MeGo?
    What I don’t get is why Lauritas can be in five or six times more in bankruptcy problems and still live in that house. I just don’t get how they are still able to live there. Can someone answer that for me?

    While we are all consumed with the news today regarding Teresa and Joe Giudice, I am going to comment on yesterday’s episode, because I cannot give a pass on this one.

    Rich Wakile has always made disgusting comments, but I think yesterday was his all time low. First, he appeared to be constantly stirring the pot between the Giudices and Gorgas..asking who won the fight? Then commenting on look how they were just yesterday and now look at them, when they were ice fishing. At dinner, telling TB to grow some balls and tell his wife to STFU, when she was drunk and making comments at the table (obviously repeating Teresa’s comment to him before the big blowup). Then finally telling Joe Giudice that he always got along with Chris and that he should take the bottle of wine to Chris, himself instead of sending it with Caroline.

    He was deliberately making these comments to see what the fallout would be and if it would kick off another argument. However, his comments regarding Dr. V. were disrespectful and chauvinistic regarding her looks and body, but yet the worst of all were the comments and actions regarding Rosie.

    When they were ice fishing, and he made reference to Larry, Curly and Mo, and he said he had seen Rosie shower before naked and how curly she was (obvious what he was referring to), and that he thought he was on Soul Train with her Afro. How vile and disgusting was that? First off, what is he doing, seeing Rosie shower, and then to make such comments–he is a pig and I can’t imagine that his wife and children are not embarrassed by him week after week. All my husband would have to do one time, is make a comment much less disgusting than that, and I would read him the riot act over and over. I would never tolerate constant nasty comments or vile sexual comments regarding anyone. Yet, he does it repeatedly. The final act was him catching Rosie when she fell back, and he catches her by groping and squeezing her breasts over and over again–as Rosie put it, “copping a feel”. As Teresa said, I would never want my brother-in-law squeezing my breasts. This man is a serious pervert and troublemaker and an embarrassment. With all the family drama, I can’t believe he kept making comments to stir the pot right after them making up, but then to go on and say the things he did to Rosie–he is a disgusting pig, and I just can’t tolerate watching him any longer.

    The other thing I was curious about, was in Heather MacLean’s tweets this past week, she referenced TSIL hanging up on Gia, and that she didn’t get it that a 12 year old was diffferent than a 2 year old, and then Heather praised Gia. Does anyone know what that was about?? I felt like it had just happened, and it was said after they were talking about TSIL’s comments about Mrs. Giudice, in her blog and how disrespectful that was. I was wondering did Gia talk to her aunt recently about what was said about her grandmother, and TSIL hung up the phone on her?? Anyone know??

    Hang in there everyone, and let’s see what happens, but in the meantime, I am not giving anyone a pass, if they deserve to be called out for their behavior as well. I am not condoning anyone’s wrongdoing, but I am not going to solely focus on the Giudices’ news of today, and then everything else is swept under the rug. They are all accountable for their behavior since they are all adults, not necessarily mature, but adult.

      Thanks Tassie, that is exactly what the others wanted or needed, was something to happen to overshadow their poor behavior, but Rich’s and Whacko’s comments over the top disgusting, for them to get a pass because of todays’ news. I am going to pray for the Giudices as I would anyone going through something so overwhelming (whether it was of their own making or not, I don’t wish trouble on anyone). However, the others are not innocent of things that were filmed or things going on outside of the filming. Whacko’s comments in her blog about it being a private joke among them all, just made it all the more disgusting that they were all involved “joking” about such things. It is not a joking matter, and that just made her look more stupid and ignorant to me. As you said, this is a very serious issue, and she should be thoroughly ashamed of herself. As for Rich, he is such a pervert, and I hope that he doesn’t get any more vulgar than he did last night. These people have some serious mental issues and I don’t put anything past them at this point. Nothing!

    I served on the Federal Grand Jury for 2 years, and when they say you can indict a ham sandwich, it’s true. On the jury you only hear ONE side. That is why so many counts. They (D.A.) throw out every thing just to see what sticks. I was disgusted by some people on the jury that didn’t care and said “I will vote the way everybody votes”. I told them they would care if it were there family member being indicted. We were given a job to do and I took that very seriously. I strongly agree in “innocent until proven guilty”. I had a family member indicted and I am also a retired cop, so I see things from both sides of the fence. I will not kick Teresa when she is down but lay down beside her and continue to support her and Joe.

      It is due to the way the USA judicial system is setup. All people charged with crimes are “innocent until proven guilty” and the burden of proof for this situation will not lie on either Juicy or Teresa. So, essentially, if there isn’t enough proof, the charges are thrown out (dropped) and become a non-factor. This is always a potential scenario when anyone is charged with a crime in the USA.

      Prosecutors tend to over-indict and overstate charges. That way they can always drop or reduce later on. Our legal system and actual justice are sometimes a universe apart. It is ludicrous on one hand to prosecute for fraud. Many self employed and upper income people used “stated income” loans. You would pay a slightly higher rate, but the benefit was to not actually have to document your income or sources in any great detail. When used judiciously, they were terrific. But historically they were used by people who *knew* they could afford to pay the loan off. It was only in our recent real estate meltdown was it found that those same loans were being used by people who could never realistically afford them . Teresa and Joe appear to have done what a large percentage of self-employed business owners did for a long time. Had they never declared bankruptcy this never would have come to pass.

    Here is some interesting information about ignorance of the law and ignorance of knowledge. According to my husband, an attorney, Teresa will be very hard pressed to use this as a defense:

    The reasonableness of the defendant’s conclusions must be based on the facts known to the defendant at the time and place that he acted unless the defendant should have reasonably apprised himself of other facts before acting.

    The defense of mistake is not available if the defendant would have been guilty of another offense had the facts been as he supposed.

    Mistake or ignorance of law is generally not available as a defense since an accused to be convicted need not have been aware of the legal standard established by the statute.

    Mistake of law like mistake of fact is not a defense if defendant would have been guilty of an offense had the situation been as he supposed.

    There are so many comments I want to respond to but I am extremely short on time again today so I will just put it all here.

    Someone asked what time Teresa and Joe have to appear in court this morning. It is 10:00am EDT.

    I want to thank all the commenters here who have far more expertise in this area of the law than I could ever have, as well as those who are in the financial industry and Cher, who sat on the grand jury for two years. Very enlightening information, giving much food for thought, and quite a bit to digest. Cher – I believe you are right that they will just throw charges out and see what sticks. It will be interesting to see how this plays out.

    I do not believe the “conspiracy” theories. This all comes down to questionable financial practices and behaviors before Teresa came on the show. By filing that bankruptcy, it opened up an enormous can of worms – and for the significant amount of money involved, of course the government was going to delve and dig as much as they can to find the money trail, even going back as far as 15 years.

    This case will take years to resolve – Teresa and Joe will not be going to jail in the near future.

    As far as the show goes, I think it is time Bravo pulls the plug. Enough is enough – they are fully aware of all of the castmates’ legal troubles, which between all of them is extensive. Bravo, because of this cast, has even been brought into their own legal issues, i.e. the brawls. I think the headaches have now become migraines.

    Teresa’s brand is damaged – it will be hard for her to continue at the pace she has. Bravo will also realize this. Staunch fans and supporters will continue to be but this will, and already has, turned people away and made people who were on the fence decide against her.

    My heart goes out to the Giudices – innocent or guilty. These charges, while some may be dropped, I believe there are others that guilt is involved. While I am empathetic towards them as I do believe Teresa does, underneath it all, have a good heart, I also am having a hard time reconciling in my mind that in the role of a parent, she did not put her children’s welfare and their best interest in front of hers. To expose them with the possibility that BOTH parents could end up doing prison time and leaving them in the care of relatives, is inexcusable in my book. As I said before, that is a tipping point for me. For me, children hold a very special place in my heart – once a parent, that is a responsibilitythat encompasses all that affects that child and is not to be taken lightly.

    That being said, this turn of events, in no way whatsoever, negates the despicable behavior from the Whorgas, the Manzos, the Lauritas, and the Wakiles. They don’t get a pass just because Teresa and Joe are now in some hot water. They can revel all they want and “celebrate” but their time will come, so they should be very careful how they tread going forward.

    Lastly, to the Giudice girls – and frankly ALL of the beautiful children on this show – I truly hope that the damage being done to them regarding what their parents have exposed them to in the past and now presently, is as minimal as it can possibly be although I fear it will have huge ramifications on them (Gessie – I cannot get you out of my mind and heart and I am wishing you nothing but good thoughts and love). May God walk with these children and keep them under His wing.

      You have a very good way of putting things, and I appreciate that. One thing I want to say, I don’t think it is a conspiracy theory to think that the rest of the cast and Bravo partook in the implications against her. I agree that this is about financial dealings that predate the show, but it now involves Bravo as her employer so would it be unheard of for Bravo to be questioned at some level? Think of how investigations work. If Bravo was questioned by the Feds and did not tell her and then in turn pointed them in the family’s direction for information ( and perhaps because of contractual obligations to Bravo the family and others felt as though their backs were against the wall??!) this–TO ME– explains the entirety of what is going on regarding everyone’s actions towards and about her.

      I know I have posted that I think Bravo and the cast are behind this, but let me be clear, I do not think they initiated the charges, I think the Giudice’s brought the charges on themselves– but I think the cast of her family and friends knew there was an investigation, have cooperated with the investigators to some degree and did not tell her about it.

As much as we’d love to blame someone else, especially one or more of those we’re not fans of on the show, it’s as wrong to do that as it is when we complain about all of them blaming Teresa for everything. This all started long before RHoNJ even existed and all these charges were already in the works before we heard anyone say a bad word about Teresa and/or Joe.

The Lauritas have defrauded many more people than the Giudices & Chris & Jax & JOGO are all being sued for assault. Why doesn’t anyone talk about the legal woes of the rest of them. They all have done some illegal things but only Joe & Teresa get crucified for it. Not Fair!!!

What mortgage loan officer doesn’t check these documents that are submitted? Not at all excusing Tre and Juicy but I want to know why major banks are getting a huge pass and are not being held responsible? Look at Joe Gorgas pyramid of financing and refinancing and cashing not only the equity but substantially more than the equity out of his house. Who does that? Does he even work? I was always curious how 30 something’s lived in such faux grand houses without any substantial.family wealth and questionable careers.     I feel like a total conspiracy theorist but I now truly believe the Laurita’s and Wakile’s have something to do with this indictment. See page 16–Joe Giudice started a clothing label business “Name Brand”–who also ran a clothing line? Chris Laurita. C

    Joe Giudice evidently had a fuel company as well–Turbo Fuel. Who was involved in litigation with Exxon and worked at/owned gas stations? Dickie Wakile.

    I think Joe went into “business” with these people with the best of intentions and when their schemes all fell through, Joe Guidice will be left holding the bag. Everyone was probably in trouble and is trying to save their own skin and turned in the Guidices.

    Don’t get me wrong, Joe and Teresa caused a lot of this grief themselves. But, the company they keep hasn’t helped them at all.

There is logic in what your instincts are telling you…I am of the thought that the other castmates/ Bravo certainly did not bring these charges about, HOWEVER, based on their actions, I think they all were aware that there was something brewing and did not tell her they were questioned…and if that is so(which we will probably never know) it is wrong on so many levels.

      I have to go with logic and based on what I have been seeing for 2 seasons…I think they all knew at the very least.

      Why is Jac so cocky when her and her family are involved in an even bigger case?

      Why does Joe Gorga project all of this hate and empty implications towards his sister and her husband, and yet we still have really no idea what the hell these people have “done” to him(and same goes for the rest of the cast really)?

      Why has the entire cast-including Andy at one point or another seemed so fixated on getting her to “admit” to stuff on camera AFTER she has specifically asked them to not discuss her legal matters on film?

      Why is it that every other cast member-to some degree larger or smaller than hers- has been involved in legal fraud matters but Teresa’s is the only one widely reported?

      What are your thoughts?

    The conspiracy charges here are ridiculous. Joe and Terea have no one to blame for themselves for the charges. When they filed bankruptcy in 2009 and LIED to the federal government, they tipped their own hand. They hid assets, lied about their incomes and submitted fraudulent tax returns in their bankruptcy filing – the IRS knew that they had not actually been filed. They apparently have been lying, cheating, stealing, forging signatures and faking documents for so long that they believed they would continue to get away with it- Joe even continued it after getting caught by the bankruptcy court, he went down to the DMV and got a fake license! They both clearly believe they are above the law and this comeupance has been a long time coming and couldn’t have happened to two more deserving people IMO. I know Teresa’s fans think she’s been working hard to pay her debts, but people like Teresa don’t operate like that…she’s been using that money to finance their current lavish lifestyle. The money they’ve already spent is meaningless to them, even if they still owe it, that much is obvious from Teresa herself!

          Lucy, while I am a fan of Teresa’s and can’t stand any of the others, Teresa did know these charges were coming or at least knew they were a strong possibility. This has been in the works since they filed bankruptcy and it all stems from that. I do disagree that Teresa hasn’t been paying back her debt and you can’t say that you know differently. These charges have nothing to do with her creditors and either paying them back or not paying them back. They still have their house so they are obviously keeping people happy. Also, people have to remember, the bankruptcy was $11 million but much of that had to do with property they had. Apparently they sold off many of those properties were reduced the amount of their debt. I completely believe that she has taken care of much of what was owed. Of course you’ll always believe whatever it is you want to believe and I’m sure you’re really enjoying this. It’s only a matter of time before you see some of the others in their own “situations” and they will no longer get the benefit of the crickets regarding same.

    Just wondering out loud here, in season 3 did it not come to light that Joe Guidice signed his partners name to a cheque ? So could he have not signed Teresa name ? I also thought that I remembered when the BK came out that Teresa knew nothing about the financial mess that they were in. I do not know but old school (Italian style) means that the women have very little impute in the financial aspect of anything or maybe just some wishful thinking.

    These are serious charges and they will be accountable for some of them. In this last episode, it just seemed to me that Joe Guidice did not want to be there at all but had to be there. It just seemed that he was sad and already knew that something was going to happen.

    As I think that momajackie can attest to, here in the New Orleans area, the FBI is very busy. It seems like monthly they are either handing down indictments or announcing a new investigation – usually people in politics or with a high profile. There is something that just doesn’t sit right with me about this. The “stuff” they have them on seems like someone went on a fishing expedition.
    So, my theory is, is that while the Guidice’s may be guilty of some indiscretions, I think that the Feds are after a bigger fish. Again, from the corruption that plagues our area, the Feds usually come down on someone and ask them to turn on someone with greater transgressions. When that fails, they indict. I suspect that Juicy didn’t want to become embroiled in a case against anyone else. This would explain why Jacqueline severed her ties with Teresa over seemingly petty BS. She was scared of their ongoing legal battles. I take you back to the Napa trip when Chris L told juicy that he didn’t appreciate him telling someone that he was shady. Could it be that everyone on the show distanced themselves from the Guidice’s because they didn’t want to be investigated?
    I don’t know, but as they say, something smells fishy in Denmark.

      You are so correct. I believe at one point almost all of New Orleans City Hall was indicted, the Jefferson’s freezer money, the land fill scandal, the ex-mayor, the list goes on and on. Just this week in Houma, it was the ex-sheriff.

      I can tell you from working in law enforcement that the Feds are not really after Tre and Joe. They want the secret and that has not been revealed to us yet. So they jack up charges and they are jacked up, because when I first saw it I was like is this for real. My guess is they are connected to the Mob, joe is not the big fish in the pond but is connected to the big fish in the pond. So they try and scare them with these silly jacked up charges, Joe will take jail time, but they really laying it on thick by putting tre in it…Joe will do time because just from his style and dealing with ppl like him while working in LEO he won’t talk or rat as they say. I do believe after this they will go after Al Manzo, although it may be alittle harder to get him. I’ve watched al he’s school mafia and he has his wife trained. Joe is old school but Teresa was too flashy not to mention you had her brother and sister-in-law dropping dymes every chance they got.

      YES! This is exactly what I am trying to say as well, the cast has been dehumanizing her and distancing themselves from her—for a reason!!! Only , we have not had full access to the context of these issues. I think they knew (even if they heard some half truth from Bravo who, as her major income may have been approached or questioned to some degree??) Anyways, they all knew something, even if it was a fraction of the truth and I think THIS explains their behavior better than anything.

      And they all stand to lose-Bravo included.

    Something seems odd in the indictment. Counts 37 and 39 citing the failure to pay taxes seem strange considering the income the government claims Joe had in the years covered is less than $30,000 in each year. If he was really a fraud – he would have filed in those years and gotten a huge refund based on mortgage interest and property taxes and dependent deductions. Something just doesn’t seem right..

      Joe’s income in the four years he failed to file was close to 1 million total, the indictment states that the income ranges from over 300k in one year to almost 30k in another. If Joe made less than 30k each year, it would only add up to 120k for the 4 year total.

      I agree. I can tell you from personal experience that someone 1099’d me and my husband but never sent it to use (long story, but it should never have been issued). We received a letter from the IRS stating that we didn’t disclose all of our income. It wasn’t until we ordered a transcript that this was found.

      I don’t know, the way this indictment is worded, at least to me, is murky at best. Including things like the W-2’s. I don’t think that they just made up W-2’s, I think that they paid T from the business that Juicy owned.

      I also find it odd because when you apply for loans you not only have to submit your taxes (w-2’s, 1099’s. etc), but you have to complete a 450T (I think that’s it) allowing the bank to get your transcripts from the IRS. It’s just odd.

        No, I have only had to submit a 4506T for my son’s college records. I never even knew there was such a thing as a tax transcript until February this year. We have not had a lot of loans, but we have had some, and we have a mortgage on the house we live in, and I had never heard of a tax transcript.

      That does indeed seem odd. I guess there is a lot more to this story than first appears. I can’t believe how worked up I got myself last night. My goodness, you’d have thought it was a family member or something. I think I will wait until they have their day in court. Hopefully they will be given the same consideration by Bravo that their fellow cast mates have been given in regards to their legal struggles. And that those fellow cast mates will show a bit of respect by not speaking of this publically other than to express support.

    Appearing in a packed hearing in federal court this morning, Teresa and Giuseppe “Joe” Giudice, two stars of the hugely popular Bravo television show, “ Real Housewives of New Jersey,” heard the major charges read aloud from a 39-count indictment that accuses them of conspiring to fraudulently obtain millions of dollars in mortgages and other loans and of hiding assets and income during their past bankruptcy proceedings.

    The married couple — who create controversy on the TV show nearly each week, with their strong personalities and propensity to argue — stared straight ahead for much of the brief hearing in Newark.

    They did not yet enter their pleas to the charges against them, as their arraignment hearing is set for Aug. 14.

    Each was released on $500,000 unsecured appearance bonds.

    At the court hearing, a federal prosecutor explained that Joe Giudice is not a citizen of the United States, but of Italy. If convicted, he would subject to immigration proceedings and would likely be deported.

    Teresa Giudice, wearing a white pants suit, her dark hair pulled back in a ponytail sat through the 15-minute hearing with little expression on her face. She was flanked by her her high profile lawyer Henry Klingeman. In the seat to Klingeman’s right sat Joe Giudice, 43, wearing a crisp, dark suit with a tie and pink shirt. He stared straight ahead through most of the proceedings, his face appearing serious and at times stern.

    Standing in the courtroom, the prosecutor listed the maximum prison sentence that each Giudice could face if convicted on certain counts. Some of the counts include a maximum 20-year sentence, others a 30-year sentence

    U.S. Attorney Paul J. Fishman said a plea deal has not been discussed when he addressed the media after the hearing.

    Fishman announced the 39-count federal indictment on Monday. If convicted, each reality TV star could face dozens of years in prison.

    Joe Giudice is also accused of failing to file tax returns from 2004 to 2008, when he allegedly earned nearly $1 million.

    “The indictment returned (by a grand jury) today alleges the Giudices lied to the bankruptcy court, to the IRS and to a number of banks,” Fishman said in a statement. “Everyone has an obligation to tell the truth when dealing with the courts, paying their taxes and applying for loans or mortgages. That’s reality.”

    She’s confined to traveling in NY/NJ (according to the Daily Mail) – no more HW trips, I guess, unless they keep them in-state. Did not know Joe was not a US citizen, I always assumed both were born here.

    Who is the other woman walking into to court with them on the other side of Joe? I thought it might be his mother, but can’t find a photo with a good view of her.

        no this is the time for melho to try and figure out how she can become the star of the show. She is thinking yes at least this mean another year for us, because this is a storyline…Of course If this happens I won’t be watching the show. I just wonder though, how is joe gorga feeling. He came on the show to see his own sister go down, but did he think about without her he and malicious have no story line. Not to mention Kathy is finished and she was from day one. Andy just wants rosie on the show that’s the only reason he shows that family. But he will probably keep Kathy another season if she can promise him that she can try and pry and get dirt about the case

      Actually, they are being smart not to tweet and it really is in their own best interests. They all know they can now fall under scrutiny.

      This is serious stuff – Teresa and Joe cannot travel outside of NJ/NY and their passports were confiscated. I guess Teresa’s appearance schedule will be quite limited now.

      This goes way beyond what any of the castmembers may want to capitalize on – Bravo, more than likely, has put a “gag” order on all of them, as Bravo have issued a “No Comment” statement.

    Can’t get over how TMZ is covering this with almost minute to minute updates! I’ma HW addict so my perception is skewed I think, but just had never considered Teresa would get this kind of coverage regardless the scandal. I haven’t seen Celebrity Apprentice mentioned at all in any of the write-ups, but wondering if that exposure is what’s making her mainstream media fodder? Wonder if The Donald had his people investigate Teresa before her appearance? I also wonder if he liked her enough to now somehow guide/advise or assist her in this mess?

    I was just joking (jokey jokey!!!!) about Juicy fleeing to Italy…it’s kind of freaky that TMZ states he’s not a US citizen? Don’t think I knew this (did I? lol) and am wondering what the pros and cons of his status if true? I’ve mentioned being a true crime follower, haven’t I? I remember several MURDER cases that non citizenship had huge impacts on the cases. Of course his lawyer would know best, but wondering if we have an Italian embassy?

    Interesting info on the possible tie with Dickie (loved this lol!) Wakile and Shady Chris’s failed businesses…altho’ I of course agree Joe & Teresa’s actions brought this on themselves…there’s no reason that there could be a mixture of things going on here, right? Not a complicated orchestrated conspiracy, but a little snitch here and a few phone calls there type thing. The businesses and the Manzo comments all are good reason to be suspicious.

    I *heart* this comment much AintP! As a veteran of several 1% marches/rallies, I think you nailed it – esp contrasting comparison of the new robber barons. As many have stated, my opinions here aren’t intended as a free pass for any Giudice illegal activities, but soooo sick of the free passes handed out to the “Corporations are people” crowd (helllllooooo Laurita’s!!!! grrrrrr) and all the Wall St. bankers that should be
    rotting next to other criminals!

    “When are all the bankers going down for all their shady dealings? Who is responsible for due diligence when granting these loans? What mortgage loan officer doesn’t check these documents that are submitted? Not at all excusing Tre and Juicy but I want to know why major banks are getting a huge pass and are not being held responsible? Look at Joe Gorgas pyramid of financing and refinancing and cashing not only the equity but substantially more than the equity out of his house. Who does that? Does he even work? BLK Water seems awfully quiet. What is Chris doing? For work I mean . The law should be applied equitably and across the board. I was always curious how 30 something’s lived in such faux grand houses without any substantial.family wealth and questionable careers.     Out of all of this, the one thing that really threw me was that Joe isn’t a US citizen. Are his parents, or his brother Pete? I would think that if they came over here as a family, they would have all applied for citizenship together. Maybe not, though, I’m not too well schooled on the route to citizenship here in the US.

    I agree with others that the feds may be trying to get to someone else through Teresa and Joe. Could be Al Manzo or Chris Laurita. Whatever’s going on, I feel so bad for their girls and for Tre and Juicy’s parents. This is awful.

      I don’t believe that the feds are trying to get to anyone other than Teresa and Joe. Teresa and Joe lied to the federal government in their bankruptcy filing, they tipped off the government to their own fraudulent finances! All the feds had to do was start digging. Joe and Teresa submitted fake IRS tax returns in their bankruptcy, like the government wasn’t going to find out that the taxes had never actually been filed?

        if you look at it Lucy not filing taxes could easily be settled. They can file amendments and hell make payment plans if they owe the gov. this happens everyday, this is nothing new. Try to look through the garbage and not just at the garbage and how high its piled and how it smells. It will distract you from seeing what’s really inside, yes they definitely have some things on them that’s for sure. But trust me love I’ve worked in L.E.O too long, its a smoke screen. The feds are good I won’t discredit them but I also know how they work, and if you know you are involved in dirt they will dangle that over your head and threaten you. They will even tell you , we don’t wont you, we know you didn’t do some of this. We want this person are you willing to take the fall for them and lose everything that you have because we can easily connect you and you will be the fall guy. Well for someone like Joe Go, wacky jack, and chris that’s all it will take. I will give Al manzo a little more credit because from watching him I don’t think hes that easy to break although I’ve seen stranger things. I do believe he will do time, just not a lot, most of those jacked up charges will be dropped like a bad habit. As far as lying on a mortgage loan, someone definitely told and I believe that It was Melissa, they don’t go looking for stuff like that. my question is are they going to arrest half of the ppl in the u.s. Honey this case is going to take a lot of twist and turns we haven’t even gotten to the middle let alone the bottom of whats going on…mark my words!!!

          Tell Wesley Snipes and Lauren Hill that not filing taxes can “easily be settled”. It was easily settled by them going to federal prison.

          The feds “went looking for stuff” because the trustee in the Giudice bankruptcy accused the Giudices of bankruptcy fraud. The Giudice’s did this to themselves. They lied to the federal government and got caught.

            Yep – Just like the Lauritas bankrupted their company to use the money for the own personal gain. Chris must be guilty because he tampered with evidence. It won’t be long before they have their day in court. Wonder if you’ll be celebrating then like you seem to be now.

    reading more of this case the prosecutors seem to be star struck too. these are high profile people, which means the prosecutors could be In the news a lot more and make a name for themselves. I don’t see but maybe two of these charges sticking, its to much propaganda and he’ll do may three years and get out.

      I hope you’re right.

      And whoever is posting the information on that other site, to be believed or not, this person certainly has the feel of an insider on the law enforcement side of the case. With all the documents in a years-long investigation I can see where they could pick up tidbits about the others on the show (besides what has been, published old news). But a production insider isn’t going to know all the ins and outs of the inside criminal backgrounds of all the cast.

      I hope Teresa and her family will be ok. The others, not so much.
